55 AN ACT
66 relating to vaccination requirements for health benefit plans or
77 insurance policies provided to business entities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 544, Insurance Code, is amended by
1010 adding Subchapter M to read as follows:
1111 SUBCHAPTER M. VACCINATION STATUS
1212 Sec. 544.601. APPLICABILITY OF SUBCHAPTER. (a) This
1313 subchapter applies to the issuer of a health benefit plan that
1414 provides benefits for medical or surgical expenses incurred as a
1515 result of a health condition, accident, or sickness, including a
1616 group, blanket, or franchise insurance policy or insurance
1717 agreement, a group hospital service contract, or a group evidence
1818 of coverage or similar coverage document that is offered by:
1919 (1) an insurance company;
2020 (2) a group hospital service corporation operating
2121 under Chapter 842;
2222 (3) a health maintenance organization operating under
2323 Chapter 843;
2424 (4) an approved nonprofit health corporation that
2525 holds a certificate of authority under Chapter 844;
2626 (5) a multiple employer welfare arrangement that holds
2727 a certificate of authority under Chapter 846;
2828 (6) a stipulated premium company operating under
2929 Chapter 884;
3030 (7) a fraternal benefit society operating under
3131 Chapter 885;
3232 (8) a Lloyd's plan operating under Chapter 941; or
3333 (9) an exchange operating under Chapter 942.
3434 (b) Notwithstanding any other law, this subchapter applies
3535 to:
3636 (1) a small employer health benefit plan subject to
3737 Chapter 1501, including coverage provided through a health group
3838 cooperative under Subchapter B of that chapter; and
3939 (2) a standard health benefit plan issued under
4040 Chapter 1507.
4141 (c) This subchapter applies to a life insurance company
4242 that:
4343 (1) issues or delivers a life insurance policy in this
4444 state; or
4545 (2) is organized under the laws of this state.
4646 (d) This subchapter applies to an insurer offering a
4747 property and casualty insurance policy to a business entity.
4848 Sec. 544.602. VACCINATION REQUIREMENTS PROHIBITED. An
4949 insurer or other issuer offering a health benefit plan, life
5050 insurance policy, property and casualty insurance policy, or any
5151 other insurance policy written for business entities may not
5252 discriminate against an employee without a vaccination by requiring
5353 as a condition to purchase or maintain coverage, including an
5454 endorsement, that each of the business's employees is vaccinated.
5555 SECTION 2. Subchapter M, Chapter 544, Insurance Code, as
5656 added by this Act, applies only to a health benefit plan or
5757 insurance policy delivered, issued for delivery, or renewed on or
5858 after January 1, 2022.
5959 SECTION 3. This Act takes effect on the 91st day after the
6060 last day of the legislative session.
