55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to acts for which a firefighter or police officer in
88 certain municipalities may be subject to disciplinary procedures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 143.052(h), Local Government Code, is
1111 amended to read as follows:
1212 (h) In the original written statement and charges and in any
1313 hearing conducted under this chapter, the department head may not
1414 complain of an act that [occurred earlier than the 180th day
1515 preceding the date the department head suspends the fire fighter or
1616 police officer. If the act is allegedly related to criminal
1717 activity including the violation of a federal, state, or local law
1818 for which the fire fighter or police officer is subject to a
1919 criminal penalty, the department head may not complain of an act
2020 that] is discovered earlier than the 180th day preceding the date
2121 the department head suspends the fire fighter or police officer.
2222 [The department head must allege that the act complained of is
2323 related to criminal activity.]
2424 SECTION 2. The change in law made by this Act applies only
2525 to a disciplinary action for conduct that occurs on or after the
2626 effective date of this Act. Conduct that occurs before the
2727 effective date of this Act is governed by the law in effect when the
2828 conduct occurred, and the former law is continued in effect for that
2929 purpose.
3030 SECTION 3. This Act takes effect on the 91st day after the
3131 last day of the legislative session.
