| 7 | 7 | | relating to acts for which a firefighter or police officer in |

| 8 | 8 | | certain municipalities may be subject to disciplinary procedures. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 143.052(h), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (h) In the original written statement and charges and in any |
|---|
| 13 | 13 | | hearing conducted under this chapter, the department head may not |
|---|
| 14 | 14 | | complain of an act that [occurred earlier than the 180th day |
|---|
| 15 | 15 | | preceding the date the department head suspends the fire fighter or |
|---|
| 16 | 16 | | police officer. If the act is allegedly related to criminal |
|---|
| 17 | 17 | | activity including the violation of a federal, state, or local law |
|---|
| 18 | 18 | | for which the fire fighter or police officer is subject to a |
|---|
| 19 | 19 | | criminal penalty, the department head may not complain of an act |
|---|
| 20 | 20 | | that] is discovered earlier than the 180th day preceding the date |
|---|
| 21 | 21 | | the department head suspends the fire fighter or police officer. |

| 22 | 22 | | [The department head must allege that the act complained of is |
|---|
| 23 | 23 | | related to criminal activity.] |

| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to a disciplinary action for conduct that occurs on or after the |
|---|
| 26 | 26 | | effective date of this Act. Conduct that occurs before the |
|---|
| 27 | 27 | | effective date of this Act is governed by the law in effect when the |
|---|
| 28 | 28 | | conduct occurred, and the former law is continued in effect for that |
|---|
| 29 | 29 | | purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 31 | 31 | | last day of the legislative session. |
