66 AN ACT
77 relating to an early voting ballot voted by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 84.032(c), Election Code, is amended to
1010 read as follows:
1111 (c) An applicant may submit a request after the close of
1212 early voting by personal appearance by appearing in person and:
1313 (1) returning the ballot to be voted by mail to the
1414 early voting clerk; or
1515 (2) executing an affidavit that the applicant:
1616 (A) has not received the ballot to be voted by
1717 mail; [or]
1818 (B) never requested a ballot to be voted by mail;
1919 or
2020 (C) received notice of a defect under Section
2121 87.0271(b) or 87.0411(b).
2222 SECTION 2. Subchapter B, Chapter 87, Election Code, is
2323 amended by adding Section 87.0271 to read as follows:
2424 Sec. 87.0271. OPPORTUNITY TO CORRECT DEFECT: SIGNATURE
2525 VERIFICATION COMMITTEE. (a) This section applies to an early
2626 voting ballot voted by mail:
2727 (1) for which the voter did not sign the carrier
2828 envelope certificate;
2929 (2) for which it cannot immediately be determined
3030 whether the signature on the carrier envelope certificate is that
3131 of the voter;
3232 (3) missing any required statement of residence; or
3333 (4) containing incomplete information with respect to
3434 a witness.
3535 (b) Not later than the second business day after discovering
3636 a defect described by Subsection (a) and before deciding whether to
3737 accept or reject a timely delivered ballot under Section 87.027,
3838 the signature verification committee shall:
3939 (1) return the carrier envelope to the voter by mail,
4040 if the signature verification committee determines that it would be
4141 possible to correct the defect and return the carrier envelope
4242 before the time the polls are required to close on election day; or
4343 (2) notify the voter of the defect by telephone or
4444 e-mail and inform the voter that the voter may request to have the
4545 voter's application to vote by mail canceled in the manner
4646 described by Section 84.032 or come to the early voting clerk's
4747 office in person not later than the sixth day after election day to
4848 correct the defect.
4949 (c) If the signature verification committee takes an action
5050 described by Subsection (b), the committee must take either action
5151 described by that subsection with respect to each ballot in the
5252 election to which this section applies.
5353 (d) A poll watcher is entitled to observe an action taken
5454 under Subsection (b).
5555 (e) The secretary of state may prescribe any procedures
5656 necessary to implement this section.
5757 (f) Notwithstanding any other law, a ballot may not be
5858 finally rejected for a reason listed in Section 87.041(b)(1), (2),
5959 or (6) before the seventh day after election day.
6060 SECTION 3. Subchapter C, Chapter 87, Election Code, is
6161 amended by adding Section 87.0411 to read as follows:
6262 Sec. 87.0411. OPPORTUNITY TO CORRECT DEFECT: EARLY VOTING
6363 BALLOT BOARD. (a) This section applies to an early voting ballot
6464 voted by mail:
6565 (1) for which the voter did not sign the carrier
6666 envelope certificate;
6767 (2) for which it cannot immediately be determined
6868 whether the signature on the carrier envelope certificate is that
6969 of the voter;
7070 (3) missing any required statement of residence; or
7171 (4) containing incomplete information with respect to
7272 a witness.
7373 (b) Not later than the second business day after discovering
7474 a defect described by Subsection (a) and before deciding whether to
7575 accept or reject a timely delivered ballot under Section 87.041,
7676 the early voting ballot board shall:
7777 (1) return the carrier envelope to the voter by mail,
7878 if the early voting ballot board determines that it would be
7979 possible to correct the defect and return the carrier envelope
8080 before the time the polls are required to close on election day; or
8181 (2) notify the voter of the defect by telephone or
8282 e-mail and inform the voter that the voter may request to have the
8383 voter's application to vote by mail canceled in the manner
8484 described by Section 84.032 or come to the early voting clerk's
8585 office in person not later than the sixth day after election day to
8686 correct the defect.
8787 (c) If the early voting ballot board takes an action
8888 described by Subsection (b), the board must take either action
8989 described by that subsection with respect to each ballot in the
9090 election to which this section applies.
9191 (d) A poll watcher is entitled to observe an action taken
9292 under Subsection (b).
9393 (e) The secretary of state may prescribe any procedures
9494 necessary to implement this section.
9595 (f) Notwithstanding any other law, a ballot may not be
9696 finally rejected for a reason listed in Section 87.041(b)(1), (2),
9797 or (6) before the seventh day after election day.
9898 SECTION 4. This Act takes effect on the 91st day after the
9999 last day of the legislative session.
