| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter B, Chapter 88, Natural |

| 11 | 11 | | Resources Code, is amended to read as follows: |

| 13 | 13 | | SECTION 2. Subchapter B, Chapter 88, Natural Resources |

| 14 | 14 | | Code, is amended by adding Section 88.014 to read as follows: |

| 15 | 15 | | Sec. 88.014. PUBLICATION OF FLARING INFORMATION. (a) In |
|---|
| 16 | 16 | | this section, "flaring intensity" means the amount of natural gas |
|---|
| 17 | 17 | | flared per barrel of oil produced. |
|---|
| 18 | 18 | | (b) On a monthly basis, the commission shall publish on the |
|---|
| 19 | 19 | | commission's Internet website: |
|---|
| 20 | 20 | | (1) the names of the operators who report the highest |
|---|
| 21 | 21 | | 20 levels of flaring; and |
|---|
| 22 | 22 | | (2) for each operator named in Subdivision (1), the |
|---|
| 23 | 23 | | level of flaring and flaring intensity. |
|---|
| 24 | 24 | | (c) On an annual basis, the commission shall publish on the |
|---|
| 25 | 25 | | commission's Internet website a report of all operators and each |
|---|
| 26 | 26 | | operator's aggregate level of flaring and flaring intensity for the |
|---|
| 27 | 27 | | year covered by the report. |
|---|
| 28 | 28 | | (d) The commission shall base information published under |
|---|
| 29 | 29 | | this section on the most current and comprehensive information |
|---|
| 30 | 30 | | available to the commission. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 32 | 32 | | last day of the legislative session. |
