55 AN ACT
66 relating to depository boxes for ballots to be voted by mail.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 86.006, Election Code, is amended by
99 amending Subsection (a) and adding Subsection (a-2) to read as
1010 follows:
1111 (a) A marked ballot voted under this chapter must be
1212 returned to the early voting clerk in the official carrier
1313 envelope. The carrier envelope may be delivered in another
1414 envelope and must be transported and delivered only by:
1515 (1) mail;
1616 (2) common or contract carrier; [or]
1717 (3) subject to Subsection (a-1), in-person delivery by
1818 the voter who voted the ballot; or
1919 (4) subject to Subsection (a-2), delivery to an
2020 authorized depository box.
2121 (a-2) The voter may deliver a sealed carrier envelope
2222 containing a marked ballot to any depository box authorized by the
2323 early voting clerk. The early voting clerk may authorize any number
2424 of suitable locations for placement of a depository box.
2525 SECTION 2. This Act takes effect September 1, 2021.
