55 AN ACT
66 relating to the registration of voters at a polling place and
77 related procedures.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 12, Election Code, is
1010 amended by adding Section 12.007 to read as follows:
1111 Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER
1212 REGISTRARS. The registrar shall appoint at least one election
1313 officer serving each polling place for early voting by personal
1414 appearance or on election day as a regular deputy registrar.
1515 SECTION 2. Chapter 63, Election Code, is amended by adding
1616 Section 63.010 to read as follows:
1717 Sec. 63.010. REGISTRATION AT POLLING PLACE; VOTING
1818 PROCEDURES. (a) Other applicable provisions of this code apply to
1919 the conduct of voting and to the registration of voters under this
2020 section to the extent those provisions do not conflict with this
2121 section.
2222 (b) A person who would be eligible to vote in an election
2323 under Section 11.001, but for the requirement to be a registered
2424 voter, shall be accepted for voting at a polling place at which the
2525 person would be allowed to vote if registered if, on the day the
2626 person offers to vote, the person:
2727 (1) submits a voter registration application that
2828 complies with Section 13.002 to a voter registrar at the polling
2929 place;
3030 (2) presents as proof of identification:
3131 (A) a Texas driver's license, including a
3232 temporary license or instruction permit, or personal
3333 identification card issued to the person by the Department of
3434 Public Safety that states the person's current address on the day
3535 the person seeks to vote; or
3636 (B) a utility bill addressed to the person dated
3737 not earlier than the 30th day before the date the person seeks to
3838 vote, and:
3939 (i) a Texas driver's license, including a
4040 temporary license or instruction permit, or personal
4141 identification card issued to the person by the Department of
4242 Public Safety, regardless of whether the address stated on the
4343 license or card is current on the day the person seeks to vote;
4444 (ii) a United States passport issued to the
4545 person; or
4646 (iii) a United States military
4747 identification card that contains the person's photograph; and
4848 (3) executes an affidavit stating that the person:
4949 (A) is eligible to vote in the election; and
5050 (B) is voting only once in the election.
5151 (c) Persons voting under this section shall be processed
5252 separately at the polling place from persons who are voting under
5353 regular procedures.
5454 (d) The secretary of state shall adopt rules to ensure the
5555 accountability of election officers and to fairly implement this
5656 section.
5757 SECTION 3. Section 85.031(a), Election Code, is amended to
5858 read as follows:
5959 (a) For each person entitled to vote an early voting ballot
6060 by personal appearance or who is entitled to register at a polling
6161 place, the early voting clerk shall follow the procedure for
6262 accepting a regular voter on election day, with the modifications
6363 necessary for the conduct of early voting.
6464 SECTION 4. The secretary of state shall adopt rules as
6565 required by Section 63.010, Election Code, as added by this Act, not
6666 later than February 1, 2022.
6767 SECTION 5. The changes in law made by this Act apply only to
6868 an election for which early voting by personal appearance begins on
6969 or after February 1, 2022.
7070 SECTION 6. This Act takes effect September 1, 2021.
