| 8 | 8 | | Management regarding building trade services following disasters. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 418, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 418.059 to read as follows: |
|---|
| 12 | 12 | | Sec. 418.059. REPORT ON BUILDING TRADE SERVICES FOLLOWING |
|---|
| 13 | 13 | | DISASTERS. (a) Not later than November 1 of each even-numbered |
|---|
| 14 | 14 | | year, the division shall submit a report to members of the |
|---|
| 15 | 15 | | legislature on improving the oversight, accountability, and |
|---|
| 16 | 16 | | availability of building trade services following disasters. The |
|---|
| 17 | 17 | | report must include: |
|---|
| 18 | 18 | | (1) the number and economic impact of tradespeople in |
|---|
| 19 | 19 | | communities affected by a disaster; |
|---|
| 20 | 20 | | (2) strategies for using a workforce that has been |
|---|
| 21 | 21 | | trained in a United States Department of Labor Industry-Recognized |
|---|
| 22 | 22 | | Apprenticeship Program or Registered Apprenticeship Program to |
|---|
| 23 | 23 | | increase the availability of tradespeople, including plumbers and |
|---|
| 24 | 24 | | electricians, following a disaster; |
|---|
| 25 | 25 | | (3) approaches to increase prosecutions of alleged |
|---|
| 26 | 26 | | fraud relating to building trade services offered following a |
|---|
| 27 | 27 | | disaster, including wage theft and worker misclassification; and |
|---|
| 28 | 28 | | (4) methods to encourage performance bond |
|---|
| 29 | 29 | | requirements in contracts for building trade services to be |
|---|
| 30 | 30 | | performed following a disaster. |
|---|
| 31 | 31 | | (b) The division shall consult with appropriate state |
|---|
| 32 | 32 | | entities, including the Texas A&M AgriLife Extension Service and |
|---|
| 33 | 33 | | Texas Department of Licensing and Regulation, local governments, |
|---|
| 34 | 34 | | trade associations, United States Department of Labor Registered |
|---|
| 35 | 35 | | Apprenticeship Programs, and law enforcement groups in preparing |
|---|
| 36 | 36 | | the report described by Subsection (a). |
|---|
| 37 | 37 | | (c) The report described by Subsection (a) must include the |
|---|
| 38 | 38 | | methodology of the contents of the report, including the type and |
|---|
| 39 | 39 | | nature of information provided by the entities described by |
|---|
| 40 | 40 | | Subsection (b). |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect on the 91st day after the |
|---|
| 42 | 42 | | last day of the legislative session. |
