66 AN ACT
77 relating to a forensic audit of 2020 election results in certain
88 counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 16, Election Code, is amended by adding
1111 Chapter 280 to read as follows:
1212 CHAPTER 280. FORENSIC AUDIT OF 2020 GENERAL ELECTION
1313 Sec. 280.001. FORENSIC AUDIT OF 2020 GENERAL ELECTION. (a)
1414 The governor, lieutenant governor, and speaker of the house of
1515 representatives shall appoint an independent third party to conduct
1616 a forensic audit of the general election that took place on November
1717 3, 2020.
1818 (b) The independent third party appointed under Subsection
1919 (a) shall audit every precinct in each county with a population of
2020 415,000 or more.
2121 (c) The audit under this section must begin not later than
2222 November 1, 2021, and be completed not later than February 1, 2022.
2323 (d) Not later than March 1, 2022, the independent third
2424 party conducting the audit under this section shall submit a report
2525 to the governor, lieutenant governor, speaker of the house of
2626 representatives, and each member of the legislature detailing any
2727 anomalies or discrepancies in voter data, ballot data, or
2828 tabulation.
2929 (e) This chapter expires April 1, 2022.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect on the 91st day after the last day of the
3535 legislative session.
