66 AN ACT
77 relating to demand response programs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 17.003(d-1), Utilities Code, as added by
1010 S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is
1111 amended to read as follows:
1212 (d-1) An electric utility providing electric delivery
1313 service for a retail electric provider, as defined by Section
1414 31.002, shall provide to the retail electric provider, and the
1515 retail electric provider shall periodically provide to the retail
1616 electric provider's retail customers together with bills sent to
1717 the customers, information about:
1818 (1) the electric utility's procedures for implementing
1919 involuntary load shedding initiated by the independent
2020 organization certified under Section 39.151 for the ERCOT power
2121 region;
2222 (2) the types of customers who may be considered
2323 critical care residential customers, critical load industrial
2424 customers, or critical load according to commission rules adopted
2525 under Section 38.076;
2626 (3) the procedure for a customer to apply to be
2727 considered a critical care residential customer, a critical load
2828 industrial customer, or critical load according to commission rules
2929 adopted under Section 38.076; [and]
3030 (4) reducing electricity use at times when involuntary
3131 load shedding events may be implemented; and
3232 (5) the procedure for a residential or commercial
3333 customer to participate in a voluntary demand response program
3434 through the electric utility or a demand response provider to
3535 reduce electricity use during times of peak demand, including
3636 during an involuntary load shedding event.
3737 SECTION 2. Section 17.005(f), Utilities Code, as added by
3838 S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is
3939 amended to read as follows:
4040 (f) A municipally owned utility shall periodically provide
4141 with bills sent to retail customers of the utility information
4242 about:
4343 (1) the utility's procedure for implementing
4444 involuntary load shedding;
4545 (2) the types of customers who may be considered
4646 critical care residential customers, critical load industrial
4747 customers, or critical load according to commission rules adopted
4848 under Section 38.076;
4949 (3) the procedure for a customer to apply to be
5050 considered a critical care residential customer, a critical load
5151 industrial customer, or critical load according to commission rules
5252 adopted under Section 38.076; [and]
5353 (4) reducing electricity use at times when involuntary
5454 load shedding events may be implemented; and
5555 (5) the procedure for a residential or commercial
5656 customer to participate in a voluntary demand response program
5757 through the utility or a demand response provider to reduce
5858 electricity use during times of peak demand, including during an
5959 involuntary load shedding event.
6060 SECTION 3. Section 17.006(f), Utilities Code, as added by
6161 S.B. No. 3, Acts of the 87th Legislature, Regular Session, 2021, is
6262 amended to read as follows:
6363 (f) An electric cooperative shall periodically provide with
6464 bills sent to retail customers of the cooperative information
6565 about:
6666 (1) the cooperative's procedure for implementing
6767 involuntary load shedding;
6868 (2) the types of customers who may be considered
6969 critical care residential customers, critical load industrial
7070 customers, or critical load according to commission rules adopted
7171 under Section 38.076;
7272 (3) the procedure for a customer to apply to be
7373 considered a critical care residential customer, a critical load
7474 industrial customer, or critical load according to commission rules
7575 adopted under Section 38.076; [and]
7676 (4) reducing electricity use at times when involuntary
7777 load shedding events may be implemented; and
7878 (5) the procedure for a residential or commercial
7979 customer to participate in a voluntary demand response program
8080 through the cooperative or a demand response provider to reduce
8181 electricity use during times of peak demand, including during an
8282 involuntary load shedding event.
8383 SECTION 4. Section 39.101(b), Utilities Code, is amended to
8484 read as follows:
8585 (b) A customer is entitled:
8686 (1) to be informed about rights and opportunities in
8787 the transition to a competitive electric industry;
8888 (2) to choose the customer's retail electric provider
8989 consistent with this chapter, to have that choice honored, and to
9090 assume that the customer's chosen provider will not be changed
9191 without the customer's informed consent;
9292 (3) to have access to providers of energy efficiency
9393 services, to on-site distributed generation, and to providers of
9494 energy generated by renewable energy resources;
9595 (4) to be served by a provider of last resort that
9696 offers a commission-approved standard service package;
9797 (5) to receive sufficient information to make an
9898 informed choice of service provider;
9999 (6) to be protected from unfair, misleading, or
100100 deceptive practices, including protection from being billed for
101101 services that were not authorized or provided; [and]
102102 (7) to have an impartial and prompt resolution of
103103 disputes with its chosen retail electric provider and transmission
104104 and distribution utility; and
105105 (8) to participate in demand response programs
106106 through:
107107 (A) retail electric providers; and
108108 (B) demand response providers.
109109 SECTION 5. This Act takes effect on the 91st day after the
110110 last day of the legislative session.
