55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to severance pay for political subdivision employees and
88 independent contractors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 180, Local Government Code, is amended
1111 by adding Section 180.010 to read as follows:
1212 Sec. 180.010. LIMITATION ON SEVERANCE PAY FOR EMPLOYEES AND
1313 INDEPENDENT CONTRACTORS. (a) In this section, "misconduct" means
1414 an act or omission by an employee or contractor of a political
1515 subdivision in the performance of the employee's or contractor's
1616 duties that the governing body of the political subdivision
1717 determines to be misconduct. The term includes any finding of
1818 criminal conduct.
1919 (b) This section applies to an action brought against a
2020 political subdivision by an employee or independent contractor of
2121 the political subdivision arising from the termination of the
2222 person's employment or contract. A court may not issue a writ of
2323 execution or mandamus in connection with a judgment in the action if
2424 the judgment does not comply with this section.
2525 (c) This section does not apply to a public or teaching
2626 hospital.
2727 (d) A political subdivision may not, as part of a severance
2828 package or as part of any other agreement or settlement made in
2929 relation to the termination of a person's employment or contract as
3030 an independent contractor, make a payment to an employee or
3131 independent contractor if:
3232 (1) the payment would:
3333 (A) be paid from tax revenue; and
3434 (B) exceed the amount of compensation, at the
3535 rate at the termination of employment or the contract, the employee
3636 or independent contractor would have been paid for 20 weeks,
3737 excluding paid time off or accrued vacation leave; or
3838 (2) the employee or independent contractor was
3939 terminated for misconduct.
4040 (e) A political subdivision shall post each severance
4141 agreement in a prominent place on the political subdivision's
4242 Internet website.
4343 SECTION 2. Section 180.010, Local Government Code, as added
4444 by this Act, applies only to a contract entered into or an action
4545 filed on or after the effective date of this Act.
4646 SECTION 3. This Act takes effect on the 91st day after the
4747 last day of the legislative session.
