66 AN ACT
77 relating to accessing transmission service and power at wholesale
88 outside of the ERCOT power region.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.166 to read as follows:
1212 Sec. 39.166. ACCESS TO WHOLESALE POWER AND TRANSMISSION
1313 SERVICE OUTSIDE THE ERCOT POWER REGION. Notwithstanding any other
1414 law, a transmission and distribution utility, municipally owned
1515 utility, or electric cooperative that transmits or distributes
1616 power purchased at wholesale in the ERCOT power region may
1717 construct, own, and operate facilities as necessary to:
1818 (1) access transmission service from outside of the
1919 ERCOT power region; and
2020 (2) purchase power at wholesale from outside of the
2121 ERCOT power region.
2222 SECTION 2. Not later than November 1, 2022, the Public
2323 Utility Commission of Texas shall examine the laws and rules
2424 governing electric utilities in this state to determine how Section
2525 39.166, Utilities Code, as added by this Act, may affect the
2626 application of those laws and rules and shall adopt recommendations
2727 for legislative and administrative action as necessary to implement
2828 that section as effectively as practicable.
2929 SECTION 3. (a) Section 39.166, Utilities Code, as added by
3030 this Act, takes effect September 1, 2023.
3131 (b) Section 2 of this Act takes effect December 1, 2021.
