| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.166 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.166. ACCESS TO WHOLESALE POWER AND TRANSMISSION |
|---|
| 13 | 13 | | SERVICE OUTSIDE THE ERCOT POWER REGION. Notwithstanding any other |
|---|
| 14 | 14 | | law, a transmission and distribution utility, municipally owned |
|---|
| 15 | 15 | | utility, or electric cooperative that transmits or distributes |
|---|
| 16 | 16 | | power purchased at wholesale in the ERCOT power region may |
|---|
| 17 | 17 | | construct, own, and operate facilities as necessary to: |
|---|
| 18 | 18 | | (1) access transmission service from outside of the |
|---|
| 19 | 19 | | ERCOT power region; and |
|---|
| 20 | 20 | | (2) purchase power at wholesale from outside of the |
|---|
| 21 | 21 | | ERCOT power region. |
|---|
| 22 | 22 | | SECTION 2. Not later than November 1, 2022, the Public |
|---|
| 23 | 23 | | Utility Commission of Texas shall examine the laws and rules |
|---|
| 24 | 24 | | governing electric utilities in this state to determine how Section |
|---|
| 25 | 25 | | 39.166, Utilities Code, as added by this Act, may affect the |
|---|
| 26 | 26 | | application of those laws and rules and shall adopt recommendations |
|---|
| 27 | 27 | | for legislative and administrative action as necessary to implement |
|---|
| 28 | 28 | | that section as effectively as practicable. |
|---|
| 29 | 29 | | SECTION 3. (a) Section 39.166, Utilities Code, as added by |
|---|
| 30 | 30 | | this Act, takes effect September 1, 2023. |
|---|
| 31 | 31 | | (b) Section 2 of this Act takes effect December 1, 2021. |
