| 8 | 8 | | officers employed by the Department of Public Safety. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 411.02091 to read as follows: |
|---|
| 12 | 12 | | Sec. 411.02091. BORDER SECURITY OFFICERS. (a) The |
|---|
| 13 | 13 | | department may employ as a border security officer to assist |
|---|
| 14 | 14 | | department efforts along the Texas-Mexico border an individual who: |
|---|
| 15 | 15 | | (1) has served in the United States armed forces and |
|---|
| 16 | 16 | | received an honorable discharge; and |
|---|
| 17 | 17 | | (2) holds a border security officer license issued by |
|---|
| 18 | 18 | | the Texas Commission on Law Enforcement. |
|---|
| 19 | 19 | | (b) The department shall develop a training program for |
|---|
| 20 | 20 | | border security officers that complies with the requirements of |
|---|
| 21 | 21 | | Subchapter P, Chapter 1701, Occupations Code. |
|---|
| 22 | 22 | | (c) The department shall deploy border security officers to |
|---|
| 23 | 23 | | serve along the Texas-Mexico border for 60 continuous days out of a |
|---|
| 24 | 24 | | 90-day period. |

| 25 | 25 | | SECTION 2. Chapter 1701, Occupations Code, is amended by |
|---|
| 26 | 26 | | adding Subchapter P to read as follows: |
|---|
| 27 | 27 | | SUBCHAPTER P. BORDER SECURITY OFFICERS |
|---|
| 28 | 28 | | Sec. 1701.751. BORDER SECURITY OFFICER LICENSE. (a) The |
|---|
| 29 | 29 | | commission shall adopt rules establishing a border security officer |
|---|
| 30 | 30 | | license for border security officers of the Department of Public |
|---|
| 31 | 31 | | Safety. |
|---|
| 32 | 32 | | (b) The rules adopted under Subsection (a) must provide for |
|---|
| 33 | 33 | | an application process for a border security officer license that |
|---|
| 34 | 34 | | is similar to the application process for a peace officer license. |
|---|
| 35 | 35 | | Sec. 1701.752. ELIGIBILITY. A border security officer |
|---|
| 36 | 36 | | license may be issued only to an individual who served in the United |
|---|
| 37 | 37 | | States armed forces and received an honorable discharge and |
|---|
| 38 | 38 | | satisfies the eligibility requirements established by commission |
|---|
| 39 | 39 | | rule. |
|---|
| 40 | 40 | | Sec. 1701.753. REQUIRED TRAINING. The commission, in |
|---|
| 41 | 41 | | consultation with the Department of Public Safety, shall establish |
|---|
| 42 | 42 | | training requirements for border security officers. |
|---|
| 43 | 43 | | Sec. 1701.754. AUTHORITY OF BORDER SECURITY OFFICER. (a) |
|---|
| 44 | 44 | | An individual who holds a border security officer license has the |
|---|
| 45 | 45 | | same authority as a peace officer except as otherwise provided by |
|---|
| 46 | 46 | | commission rule. |
|---|
| 47 | 47 | | (b) The commission, in consultation with the Department of |
|---|
| 48 | 48 | | Public Safety, shall adopt rules to implement this section. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 50 | 50 | | last day of the legislative session. |
