| 7 | 7 | | relating to voting system equipment used by counties participating |
|---|
| 8 | 8 | | in the countywide polling place program. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 43.007(c) and (d), Election Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) In conducting the program, the secretary of state shall |
|---|
| 13 | 13 | | provide for an audit of the voting system equipment [direct |
|---|
| 14 | 14 | | recording electronic voting units] before and after the election, |
|---|
| 15 | 15 | | and during the election to the extent such an audit is practicable. |
|---|
| 16 | 16 | | (d) The secretary of state shall select to participate in |
|---|
| 17 | 17 | | the program each county that: |
|---|
| 18 | 18 | | (1) has held a public hearing under Subsection (b); |
|---|
| 19 | 19 | | (2) has submitted documentation listing the steps |
|---|
| 20 | 20 | | taken to solicit input on participating in the program by |
|---|
| 21 | 21 | | organizations or persons who represent the interests of voters; |
|---|
| 22 | 22 | | (3) has implemented a computerized voter registration |
|---|
| 23 | 23 | | list that allows an election officer at the polling place to verify |
|---|
| 24 | 24 | | that a voter has not previously voted in the election; |
|---|
| 25 | 25 | | (4) uses direct recording electronic voting machines, |
|---|
| 26 | 26 | | ballot marking devices, or hand-marked scannable paper ballots that |
|---|
| 27 | 27 | | are printed and scanned at the polling place or any other type of |
|---|
| 28 | 28 | | voting system equipment that the secretary of state determines is |
|---|
| 29 | 29 | | capable of processing votes for each type of ballot to be voted in |
|---|
| 30 | 30 | | the county; and |
|---|
| 31 | 31 | | (5) is determined by the secretary of state to have the |
|---|
| 32 | 32 | | appropriate technological capabilities. |
|---|
| 33 | 33 | | SECTION 2. Section 43.007(i), Election Code, is repealed. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect on the 91st day after the last day of the |
|---|
| 39 | 39 | | legislative session. |
