66 AN ACT
77 relating to the secretary of state posting on the secretary of
88 state's Internet website databases containing certain information
99 about elections.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 4.003, Election Code, is amended by
1212 amending Subsection (e) and adding Subsection (e-1) to read as
1313 follows:
1414 (e) The authority responsible for giving notice of the
1515 election shall deliver:
1616 (1) to the secretary of state a copy of the notice of a
1717 consolidated precinct required by Subsection (b) not later than the
1818 date of the election; and
1919 (2) in January of each year information for the
2020 secretary of state's database of election information under Section
2121 31.017 in an electronic format as follows:
2222 (A) if the authority is a county or political
2323 party, as required by the secretary of state; or
2424 (B) if the authority is a political subdivision
2525 other than a county, to the county in which the authority is
2626 located.
2727 (e-1) A county receiving information under Subsection
2828 (e)(2)(B) shall forward the information to the secretary of state.
2929 SECTION 2. Subchapter A, Chapter 31, Election Code, is
3030 amended by adding Sections 31.017 and 31.018 to read as follows:
3131 Sec. 31.017. INTERNET DATABASE OF ELECTION INFORMATION.
3232 (a) The secretary of state shall post on the secretary of state's
3333 public Internet website a database containing information provided
3434 under Sections 4.003(e) and (e-1). The database must include the
3535 following information:
3636 (1) the name of the authority;
3737 (2) each office to be filled at the election;
3838 (3) whether the office is elected at large or by
3939 district; and
4040 (4) the dates of the preceding and next election for
4141 the office.
4242 (b) The secretary of state shall adopt rules as necessary to
4343 implement this section.
4444 Sec. 31.018. INTERNET DATABASE FOR INCUMBENTS AND
4545 CANDIDATES. (a) The secretary of state shall post on the secretary
4646 of state's Internet website a database containing information about
4747 each holder of and candidate for any partisan elected office in this
4848 state.
4949 (b) The database must include the following information
5050 about a holder of a partisan elected office, the office of mayor, or
5151 a position on the governing body of a city:
5252 (1) name;
5353 (2) office title, including any district, place, or
5454 position and a notation that the person is an incumbent;
5555 (3) if the office is elected at large or by district;
5656 (4) date of the previous and next election for the
5757 office;
5858 (5) public mailing address;
5959 (6) public telephone number, if available; and
6060 (7) public e-mail address, if available.
6161 (c) The database must include the following information
6262 about a candidate for a partisan elected office, the office of
6363 mayor, or a position on the governing body of a city:
6464 (1) name;
6565 (2) office sought, including any district, place, or
6666 position;
6767 (3) if the office is elected at large or by district;
6868 (4) date of the election;
6969 (5) public mailing address;
7070 (6) public telephone number, if available;
7171 (7) public e-mail address, if available; and
7272 (8) if the candidate has filed as a write-in
7373 candidate.
7474 (d) The county with whom a declaration of candidacy is
7575 filed, a state or county chair of a political party, or the
7676 presiding officer of a political party's convention shall provide
7777 information about a candidate or officeholder to the secretary of
7878 state. A political subdivision shall provide information about a
7979 candidate or officeholder to the county in which the political
8080 subdivision is located and the county shall forward that
8181 information to the secretary of state.
8282 (e) The secretary of state shall make the name, office, and
8383 party affiliation of the holder of a partisan elected office, the
8484 office of mayor, or a position on the governing body of a city
8585 available on the secretary of state's Internet website for as long
8686 as the person holds that office.
8787 (f) The secretary of state shall adopt rules as necessary to
8888 implement this section.
8989 SECTION 3. Section 141.032, Election Code, is amended by
9090 adding Subsection (h) to read as follows:
9191 (h) A county or political party with whom an application is
9292 filed shall provide the secretary of state with the candidate's
9393 information required for the secretary of state's Internet website
9494 under Section 31.018. A political subdivision with whom an
9595 application is filed shall provide the candidate's information to
9696 the county in which the political subdivision is located and the
9797 county shall forward the candidate's information to the secretary
9898 of state.
9999 SECTION 4. This Act takes effect immediately if it receives
100100 a vote of two-thirds of all the members elected to each house, as
101101 provided by Section 39, Article III, Texas Constitution. If this
102102 Act does not receive the vote necessary for immediate effect, this
103103 Act takes effect on the 91st day after the last day of the
104104 legislative session.
