| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 552.053, Local Government Code, is | |
| 10 | 10 | amended by adding Subsections (d-2) and (d-3) to read as follows: | |
| 11 | 11 | (d-2) A municipality may exempt property from all or a | |
| 12 | 12 | portion of drainage charges under Section 552.047 if the property | |
| 13 | 13 | is used as the principal residence of an individual who is: | |
| 14 | 14 | (1) disabled as defined by Section 11.13(m), Tax Code; | |
| 15 | 15 | (2) 65 years of age or older; | |
| 16 | 16 | (3) a veteran of the armed services of the United | |
| 17 | 17 | States; or | |
| 18 | 18 | (4) a member of the armed services of the United States | |
| 19 | 19 | on active deployment. | |
| 20 | 20 | (d-3) The municipality may impose additional eligibility | |
| 21 | 21 | requirements for an exemption authorized under Subsection (d-2). | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect on the 91st day after the last day of the | |
| 27 | 27 | legislative session. |
