44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the election of certain unopposed candidates.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 2.053(a), Election Code, is amended to
99 read as follows:
1010 (a) On receipt of the certification, the governing body of
1111 the political subdivision by order or ordinance shall [may] declare
1212 each unopposed candidate elected to the office. If no election is
1313 to be held on election day by the political subdivision, a copy of
1414 the order or ordinance shall be posted on election day at each
1515 polling place used or that would have been used in the election.
1616 SECTION 2. Section 2.056(c), Election Code, is amended to
1717 read as follows:
1818 (c) A certifying authority shall [may] declare a candidate
1919 elected to an office of the state or county government if, were the
2020 election held, only the votes cast for that candidate in the
2121 election for that office may be counted.
2222 SECTION 3. Section 52.092(a), Election Code, is amended to
2323 read as follows:
2424 (a) Except as provided by Section 2.053(c) or 2.056(e), for
2525 [For] an election at which offices regularly filled at the general
2626 election for state and county officers are to appear on the ballot,
2727 the offices shall be listed in the following order:
2828 (1) offices of the federal government;
2929 (2) offices of the state government:
3030 (A) statewide offices;
3131 (B) district offices;
3232 (3) offices of the county government:
3333 (A) county offices;
3434 (B) precinct offices.
3535 SECTION 4. This Act takes effect on the 91st day after the
3636 last day of the legislative session.
