66 AN ACT
77 relating to requiring public school and public institution of
88 higher education students to participate in interscholastic
99 athletic activities based on biological sex.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1212 amended by adding Section 33.0834 to read as follows:
1313 Sec. 33.0834. INTERSCHOLASTIC ATHLETIC PARTICIPATION BASED
1414 ON BIOLOGICAL SEX. (a) Except as provided by Subsection (b), an
1515 interscholastic athletic team sponsored or authorized by a school
1616 district or open-enrollment charter school may not allow a student
1717 to participate in an interscholastic athletic activity sponsored or
1818 authorized by the district or school that is designated for the
1919 biological sex opposite to the student's biological sex as
2020 determined at the student's birth and correctly stated on the
2121 student's official birth certificate.
2222 (b) An interscholastic athletic team described by
2323 Subsection (a) may allow a female student to participate in an
2424 interscholastic athletic activity that is designated for male
2525 students if a corresponding interscholastic athletic activity
2626 designated for female students is not offered or available.
2727 (c) For purposes of this section, a statement of a student's
2828 biological sex on the student's official birth certificate is
2929 considered to have correctly stated the student's biological sex as
3030 determined at the student's birth if the statement was:
3131 (1) entered at or near the time of the student's birth,
3232 as determined by University Interscholastic League rule; or
3333 (2) modified to correct a clerical error in the
3434 student's biological sex.
3535 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
3636 amended by adding Section 51.980 to read as follows:
3737 Sec. 51.980. INTERSCHOLASTIC ATHLETIC PARTICIPATION BASED
3838 ON BIOLOGICAL SEX. (a) In this section, "institution of higher
3939 education" has the meaning assigned by Section 61.003.
4040 (b) Except as provided by Subsection (c), an
4141 interscholastic athletic team sponsored or authorized by an
4242 institution of higher education may not allow a student to
4343 participate in an interscholastic athletic activity sponsored or
4444 authorized by the institution that is designated for the biological
4545 sex opposite to the student's biological sex as determined at the
4646 student's birth and correctly stated on the student's official
4747 birth certificate.
4848 (c) An interscholastic athletic team described by
4949 Subsection (b) may allow a female student to participate in an
5050 interscholastic athletic activity that is designated for male
5151 students if a corresponding interscholastic athletic activity
5252 designated for female students is not offered or available.
5353 (d) For purposes of this section, a statement of a student's
5454 biological sex on the student's official birth certificate is
5555 considered to have correctly stated the student's biological sex as
5656 determined at the student's birth if the statement was:
5757 (1) entered at or near the time of the student's birth,
5858 as determined by Texas Higher Education Coordinating Board rule; or
5959 (2) modified to correct a clerical error in the
6060 student's biological sex.
6161 SECTION 3. (a) Section 33.0834, Education Code, as added by
6262 this Act, applies beginning with the 2021-2022 school year.
6363 (b) Section 51.980, Education Code, as added by this Act,
6464 applies beginning with the 2021-2022 academic year.
6565 SECTION 4. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect on the 91st day after the last day of the
7070 legislative session.
