44 A JOINT RESOLUTION
55 proposing a constitutional amendment authorizing the legislature
66 to exempt from ad valorem taxation the total assessed value of the
77 residence homestead of an unpaid caregiver of an individual who is
88 eligible to receive long-term services and supports under the
99 Medicaid program while the individual is on a waiting list for the
1010 services and supports.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article VIII, Texas Constitution, is amended by
1313 adding Section 1-q to read as follows:
1414 Sec. 1-q. The legislature by general law may exempt from ad
1515 valorem taxation the total assessed value of the residence
1616 homestead of an unpaid caregiver of an individual who is eligible
1717 to receive certain long-term services and supports through a
1818 program established under federal law that provides health care
1919 and related services and benefits to persons with disabilities and
2020 under which this state receives federal matching money during the
2121 period the individual is on a waiting list for the services and
2222 supports. The legislature by general law may provide additional
2323 eligibility requirements for the exemption.
2424 SECTION 2. This proposed constitutional amendment shall be
2525 submitted to the voters at an election to be held November 2, 2021.
2626 The ballot shall be printed to permit voting for or against the
2727 proposition: "The constitutional amendment authorizing the
2828 legislature to exempt from ad valorem taxation the total assessed
2929 value of the residence homestead of an unpaid caregiver of an
3030 individual who is eligible to receive long-term services and
3131 supports under the Medicaid program while the individual is on a
3232 waiting list for the services and supports."
