66 AN ACT
77 relating to an interstate compact on border security and
88 immigration enforcement.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 7, Government Code, is amended by adding
1111 Chapter 794 to read as follows:
1212 CHAPTER 794. INTERSTATE COMPACT FOR BORDER SECURITY
1313 Sec. 794.001. DEFINITION. In this chapter, "illegal alien"
1414 means a person who:
1515 (1) is not a citizen or national of the United States;
1616 and
1717 (2) is unlawfully present in the United States
1818 according to the terms of 8 U.S.C. Section 1101 et seq.
1919 Sec. 794.002. AUTHORITY TO EXECUTE INTERSTATE COMPACT. On
2020 behalf of this state, the governor may:
2121 (1) coordinate, develop, and execute an interstate
2222 compact for border security among interested states; and
2323 (2) seek the approval of the United States Congress
2424 for the compact.
2525 Sec. 794.003. CONGRESSIONAL APPROVAL. The compact
2626 authorized by this chapter takes effect only if approved by the
2727 United States Congress not later than the 10th anniversary of the
2828 date the compact is executed by the governor under Section 794.002.
2929 Sec. 794.004. INTERSTATE COMPACT PROVISIONS. The compact
3030 authorized by this chapter must provide for joint action among
3131 compacting states on matters that include:
3232 (1) the operational control of this state's border
3333 with Mexico by the total detection and apprehension or deflection
3434 of illegal aliens attempting to cross the border into this state;
3535 and
3636 (2) any other enforcement of federal immigration laws,
3737 including the detecting, apprehending, detaining, prosecuting,
3838 releasing, and monitoring of illegal aliens.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect on the 91st day after the last day of the
4444 legislative session.
