411 A BILL TO BE ENTITLED
512 AN ACT
613 relating to requiring public school and public institution of
714 higher education students to compete in interscholastic athletic
815 competitions based on biological sex.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1118 amended by adding Section 33.0834 to read as follows:
1219 Sec. 33.0834. INTERSCHOLASTIC ATHLETIC COMPETITION BASED
1320 ON BIOLOGICAL SEX. (a) Except as provided by Subsection (b), an
1421 interscholastic athletic team sponsored or authorized by a school
1522 district or open-enrollment charter school may not allow a student
1623 to compete on the team in an interscholastic athletic competition
1724 sponsored or authorized by the district or school that is
1825 designated for the biological sex opposite to the student's
1926 biological sex as correctly stated on:
2027 (1) the student's official birth certificate, as
2128 described by Subsection (c); or
2229 (2) if the student's official birth certificate
2330 described by Subdivision (1) is unobtainable, another government
2431 record.
2532 (b) An interscholastic athletic team described by
2633 Subsection (a) may allow a female student to compete in an
2734 interscholastic athletic competition that is designated for male
2835 students if a corresponding interscholastic athletic competition
2936 designated for female students is not offered or available.
3037 (c) For purposes of this section, a statement of a student's
3138 biological sex on the student's official birth certificate is
3239 considered to have correctly stated the student's biological sex
3340 only if the statement was:
3441 (1) entered at or near the time of the student's birth;
3542 or
3643 (2) modified to correct a clerical error in the
3744 student's biological sex.
3845 (d) The University Interscholastic League shall adopt rules
3946 to implement this section, provided that the rules must be approved
4047 by the commissioner in accordance with Section 33.083(b).
4148 (e) A student who attends a school district or
4249 open-enrollment charter school that sponsors or authorizes an
4350 interscholastic athletic team that violates this section may bring
4451 a civil action against the district or school if the student is
4552 directly harmed by the violation. The student may obtain:
4653 (1) injunctive relief; and
4754 (2) court costs and reasonable attorney's fees.
4855 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
4956 amended by adding Section 51.980 to read as follows:
5057 Sec. 51.980. INTERSCHOLASTIC ATHLETIC COMPETITION BASED ON
5158 BIOLOGICAL SEX. (a) In this section, "institution of higher
5259 education" has the meaning assigned by Section 61.003.
5360 (b) Except as provided by Subsection (c), an
5461 interscholastic athletic team sponsored or authorized by an
5562 institution of higher education may not allow a student to compete
5663 on the team in an interscholastic athletic competition sponsored or
5764 authorized by the institution that is designated for the biological
5865 sex opposite to the student's biological sex as correctly stated
5966 on:
6067 (1) the student's official birth certificate, as
6168 described by Subsection (d); or
6269 (2) if the student's official birth certificate
6370 described by Subdivision (1) is unobtainable, another government
6471 record.
6572 (c) An interscholastic athletic team described by
6673 Subsection (b) may allow a female student to compete in an
6774 interscholastic athletic competition that is designated for male
6875 students if a corresponding interscholastic athletic competition
6976 designated for female students is not offered or available.
7077 (d) For purposes of this section, a statement of a student's
7178 biological sex on the student's official birth certificate is
7279 considered to have correctly stated the student's biological sex
7380 only if the statement was:
7481 (1) entered at or near the time of the student's birth;
7582 or
7683 (2) modified to correct a clerical error in the
7784 student's biological sex.
7885 (e) A student who attends an institution of higher education
7986 that sponsors or authorizes an interscholastic athletic team that
8087 violates this section may bring a civil action against the
8188 institution if the student is directly harmed by the violation. The
8289 student may obtain:
8390 (1) injunctive relief; and
8491 (2) court costs and reasonable attorney's fees.
8592 SECTION 3. (a) Section 33.0834, Education Code, as added by
8693 this Act, applies beginning with the 2021-2022 school year.
8794 (b) Section 51.980, Education Code, as added by this Act,
8895 applies beginning with the 2021-2022 academic year.
8996 SECTION 4. If any provision of this Act or its application
9097 to any person or circumstance is held invalid, the invalidity does
9198 not affect other provisions or applications of this Act that can be
9299 given effect without the invalid provision or application, and to
93100 this end the provisions of this Act are declared to be severable.
94101 SECTION 5. This Act takes effect immediately if it receives
95102 a vote of two-thirds of all the members elected to each house, as
96103 provided by Section 39, Article III, Texas Constitution. If this
97104 Act does not receive the vote necessary for immediate effect, this
98105 Act takes effect on the 91st day after the last day of the
99106 legislative session.
