77 relating to procedures for early voting by mail or voting by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 81, Election Code, is amended by adding
1010 Section 81.006 to read as follows:
1111 Sec. 81.006. MODIFICATION OF EARLY VOTING BY MAIL OR VOTING
1212 BY MAIL QUALIFICATIONS AND PROCEDURES. Except as specifically
1313 permitted by statute, the qualifications and procedures for early
1414 voting by mail or voting by mail may not be amended or suspended for
1515 any reason.
1616 SECTION 2. Section 418.016, Government Code, is amended by
1717 adding Subsection (i) to read as follows:
1818 (i) Notwithstanding Subsection (a) and except as provided
1919 by this subsection, the governor may not suspend a provision of a
2020 statute, order, or rule under this section if the provision, order,
2121 or rule is related to the qualifications or procedures for early
2222 voting by mail or voting by mail. On declaration of a state of
2323 disaster, the governor may suspend Section 86.006(a-1), Election
2424 Code, only for the purpose of allowing a voter registered to vote at
2525 an address located in a disaster area to deliver a marked ballot to
2626 the early voting clerk's office on or before election day.
2727 SECTION 3. Section 418.108, Government Code, is amended by
2828 adding Subsection (j) to read as follows:
2929 (j) The presiding officer of the governing body of a
3030 political subdivision may not suspend a provision of a statute,
3131 order, or rule under this section if the provision, order, or rule
3232 is related to the qualifications or procedures for early voting by
3333 mail or voting by mail.
3434 SECTION 4. This Act takes effect on the 91st day after the
3535 last day of the legislative session.
