| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 81, Election Code, is amended by adding |
|---|
| 10 | 10 | | Section 81.006 to read as follows: |
|---|
| 11 | 11 | | Sec. 81.006. MODIFICATION OF EARLY VOTING BY MAIL OR VOTING |
|---|
| 12 | 12 | | BY MAIL QUALIFICATIONS AND PROCEDURES. Except as specifically |
|---|
| 13 | 13 | | permitted by statute, the qualifications and procedures for early |
|---|
| 14 | 14 | | voting by mail or voting by mail may not be amended or suspended for |
|---|
| 15 | 15 | | any reason. |
|---|
| 16 | 16 | | SECTION 2. Section 418.016, Government Code, is amended by |
|---|
| 17 | 17 | | adding Subsection (i) to read as follows: |
|---|
| 18 | 18 | | (i) Notwithstanding Subsection (a) and except as provided |
|---|
| 19 | 19 | | by this subsection, the governor may not suspend a provision of a |
|---|
| 20 | 20 | | statute, order, or rule under this section if the provision, order, |
|---|
| 21 | 21 | | or rule is related to the qualifications or procedures for early |
|---|
| 22 | 22 | | voting by mail or voting by mail. On declaration of a state of |
|---|
| 23 | 23 | | disaster, the governor may suspend Section 86.006(a-1), Election |
|---|
| 24 | 24 | | Code, only for the purpose of allowing a voter registered to vote at |
|---|
| 25 | 25 | | an address located in a disaster area to deliver a marked ballot to |
|---|
| 26 | 26 | | the early voting clerk's office on or before election day. |
|---|
| 27 | 27 | | SECTION 3. Section 418.108, Government Code, is amended by |
|---|
| 28 | 28 | | adding Subsection (j) to read as follows: |
|---|
| 29 | 29 | | (j) The presiding officer of the governing body of a |
|---|
| 30 | 30 | | political subdivision may not suspend a provision of a statute, |
|---|
| 31 | 31 | | order, or rule under this section if the provision, order, or rule |
|---|
| 32 | 32 | | is related to the qualifications or procedures for early voting by |
|---|
| 33 | 33 | | mail or voting by mail. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect on the 91st day after the |
|---|
| 35 | 35 | | last day of the legislative session. |
|---|
