77 relating to abortion reporting and exemptions to abortion facility
88 licensing; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 171, Health and Safety
1111 Code, is amended by adding Section 171.009 to read as follows:
1212 Sec. 171.009. REPORTING REQUIREMENTS FOR ABORTIONS
1313 PERFORMED OUTSIDE ABORTION FACILITY; CRIMINAL OFFENSE. (a) A
1414 physician who performs an abortion at a location other than an
1515 abortion facility licensed under Chapter 245 must complete and
1616 submit a monthly report to the commission on each abortion
1717 performed by the physician. The report must be submitted on a form
1818 provided by the commission.
1919 (b) The report may not identify by any means the patient.
2020 (c) The report must include:
2121 (1) the type of facility at which the abortion was
2222 performed and the licensing status of that facility;
2323 (2) the patient's year of birth, race, marital status,
2424 and state and county of residence;
2525 (3) the type of abortion procedure performed;
2626 (4) the date the abortion was performed;
2727 (5) whether the patient survived the abortion, and if
2828 the patient did not survive, the cause of death;
2929 (6) the probable post-fertilization age of the unborn
3030 child based on the best medical judgment of the attending physician
3131 at the time of the procedure;
3232 (7) the date, if known, of the patient's last menstrual
3333 cycle;
3434 (8) the number of previous live births of the patient;
3535 (9) the number of previous induced abortions of the
3636 patient; and
3737 (10) the county in which the abortion was performed.
3838 (d) All information and records held by the commission under
3939 this section are confidential and are not open records for the
4040 purposes of Chapter 552, Government Code. That information may not
4141 be released or made public on subpoena or otherwise, except that
4242 release may be made:
4343 (1) for statistical purposes, but only if a person,
4444 patient, or physician performing an abortion is not identified;
4545 (2) with the consent of each person, patient, and
4646 physician identified in the information released;
4747 (3) to medical personnel, appropriate state agencies,
4848 or county and district courts to enforce this chapter; or
4949 (4) to appropriate state licensing boards to enforce
5050 state licensing laws.
5151 (e) A person commits an offense if the person violates
5252 Subsection (b), (c), or (d). An offense under this subsection is a
5353 Class A misdemeanor.
5454 (f) Not later than the 15th day of each month, a physician
5555 shall submit to the commission the report required by this section
5656 for each abortion performed by the physician at a location other
5757 than an abortion facility in the preceding calendar month.
5858 (g) The commission shall establish and maintain a secure
5959 electronic reporting system for the submission of the reports
6060 required by this section. The commission shall adopt procedures to
6161 enforce this section and to ensure that only physicians who perform
6262 one or more abortions during the preceding calendar month are
6363 required to file the reports under this section for that month.
6464 SECTION 2. Section 245.004, Health and Safety Code, as
6565 amended by Chapters 198 (H.B. 2292) and 999 (H.B. 15), Acts of the
6666 78th Legislature, Regular Session, 2003, is reenacted and amended
6767 to read as follows:
6868 Sec. 245.004. EXEMPTIONS FROM LICENSING REQUIREMENT. (a)
6969 The following facilities need not be licensed under this chapter:
7070 (1) a hospital licensed under Chapter 241 (Texas
7171 Hospital Licensing Law); [or]
7272 (2) the office of a physician licensed under Subtitle
7373 B, Title 3, Occupations Code, unless the office is used
7474 substantially for the purpose of performing [more than 50]
7575 abortions; or
7676 (3) an ambulatory surgical center licensed under
7777 Chapter 243.
7878 (b) For purposes of this section, a facility is used
7979 substantially for the purpose of performing abortions if the
8080 facility:
8181 (1) is a provider for performing:
8282 (A) at least five [10] abortion procedures during
8383 any month; or
8484 (B) at least 50 [100] abortion procedures in a
8585 12-month period [year];
8686 (2) operates less than 20 days in a month and the
8787 facility, in any month, is a provider for performing a number of
8888 abortion procedures that would be equivalent to at least five [10]
8989 procedures in a month if the facility were operating at least 20
9090 days in a month;
9191 (3) holds itself out to the public as an abortion
9292 provider by advertising by any public means, including advertising
9393 placed in a newspaper, telephone directory, magazine, or electronic
9494 medium, that the facility performs abortions; or
9595 (4) applies for an abortion facility license.
9696 (b-1) In computing the number of abortions performed for
9797 purposes of Subsections (b)(1) and (2), an abortion performed in
9898 accordance with Section 245.016 is not included.
9999 (c) For purposes of this section, an abortion facility is
100100 operating if the facility is open for any period of time during a
101101 day and has on site at the facility or on call a physician available
102102 to perform abortions.
103103 SECTION 3. Section 245.011(c), Health and Safety Code, as
104104 effective September 1, 2021, is amended to read as follows:
105105 (c) The report must include:
106106 (1) whether the abortion facility at which the
107107 abortion is performed is licensed under this chapter;
108108 (2) the patient's year of birth, race, marital status,
109109 and state and county of residence;
110110 (3) the type of abortion procedure performed;
111111 (4) the date the abortion was performed;
112112 (5) whether the patient survived the abortion, and if
113113 the patient did not survive, the cause of death;
114114 (6) the probable post-fertilization age of the unborn
115115 child based on the best medical judgment of the attending physician
116116 at the time of the procedure;
117117 (7) the date, if known, of the patient's last menstrual
118118 cycle;
119119 (8) the number of previous live births of the patient;
120120 (9) the number of previous induced abortions of the
121121 patient;
122122 (10) whether the abortion was performed or induced
123123 because of a medical emergency and any medical condition of the
124124 pregnant woman that required the abortion; [and]
125125 (11) the county in which the abortion was performed;
126126 and
127127 (12) the information required under Sections
128128 171.008(a) and (c).
129129 SECTION 4. Section 245.002, Health and Safety Code, is
130130 amended by adding Subdivision (3) to read as follows:
131131 (3) "Commission" means the Health and Human Services
132132 Commission.
133133 SECTION 5. Section 245.0116, Health and Safety Code, is
134134 amended to read as follows:
135135 Sec. 245.0116. COMMISSION [DEPARTMENT] REPORT. (a) The
136136 commission [department] shall publish on its Internet website a
137137 monthly report containing aggregate data of the information in the
138138 reports submitted under Sections [Section] 171.009 and 245.011. The
139139 report must specify the number of abortions performed in each
140140 county during the reporting period.
141141 (b) The commission's [department's] monthly report may not
142142 identify by any means an abortion facility, a physician performing
143143 the abortion, or a patient.
144144 SECTION 6. The changes in law made by this Act apply only to
145145 an abortion performed on or after the effective date of this Act.
146146 SECTION 7. This Act takes effect December 1, 2021.
