55 AN ACT
66 relating to an early voting ballot voted by mail.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 84.032(c), Election Code, is amended to
99 read as follows:
1010 (c) An applicant may submit a request after the close of
1111 early voting by personal appearance by appearing in person and:
1212 (1) returning the ballot to be voted by mail to the
1313 early voting clerk; or
1414 (2) executing an affidavit that the applicant:
1515 (A) has not received the ballot to be voted by
1616 mail; [or]
1717 (B) never requested a ballot to be voted by mail;
1818 or
1919 (C) received notice of a defect under Section
2020 87.0271(b) or 87.0411(b).
2121 SECTION 2. Subchapter B, Chapter 87, Election Code, is
2222 amended by adding Section 87.0271 to read as follows:
2323 Sec. 87.0271. OPPORTUNITY TO CORRECT DEFECT: SIGNATURE
2424 VERIFICATION COMMITTEE. (a) This section applies to an early
2525 voting ballot voted by mail:
2626 (1) for which the voter did not sign the carrier
2727 envelope certificate;
2828 (2) for which it cannot immediately be determined
2929 whether the signature on the carrier envelope certificate is that
3030 of the voter;
3131 (3) missing any required statement of residence; or
3232 (4) containing incomplete information with respect to
3333 a witness.
3434 (b) Not later than the second business day after discovering
3535 a defect described by Subsection (a) and before deciding whether to
3636 accept or reject a timely delivered ballot under Section 87.027,
3737 the signature verification committee shall:
3838 (1) return the carrier envelope to the voter by mail,
3939 if the signature verification committee determines that it would be
4040 possible to correct the defect and return the carrier envelope
4141 before the time the polls are required to close on election day; or
4242 (2) notify the voter of the defect by telephone or
4343 e-mail and inform the voter that the voter may request to have the
4444 voter's application to vote by mail canceled in the manner
4545 described by Section 84.032 or come to the early voting clerk's
4646 office in person not later than the sixth day after election day to
4747 correct the defect.
4848 (c) If the signature verification committee takes an action
4949 described by Subsection (b), the committee must take either action
5050 described by that subsection with respect to each ballot in the
5151 election to which this section applies.
5252 (d) A poll watcher is entitled to observe an action taken
5353 under Subsection (b).
5454 (e) The secretary of state may prescribe any procedures
5555 necessary to implement this section.
5656 (f) Notwithstanding any other law, a ballot may not be
5757 finally rejected for a reason listed in Section 87.041(b)(1), (2),
5858 or (6) before the seventh day after election day.
5959 SECTION 3. Subchapter C, Chapter 87, Election Code, is
6060 amended by adding Section 87.0411 to read as follows:
6161 Sec. 87.0411. OPPORTUNITY TO CORRECT DEFECT: EARLY VOTING
6262 BALLOT BOARD. (a) This section applies to an early voting ballot
6363 voted by mail:
6464 (1) for which the voter did not sign the carrier
6565 envelope certificate;
6666 (2) for which it cannot immediately be determined
6767 whether the signature on the carrier envelope certificate is that
6868 of the voter;
6969 (3) missing any required statement of residence; or
7070 (4) containing incomplete information with respect to
7171 a witness.
7272 (b) Not later than the second business day after discovering
7373 a defect described by Subsection (a) and before deciding whether to
7474 accept or reject a timely delivered ballot under Section 87.041,
7575 the early voting ballot board shall:
7676 (1) return the carrier envelope to the voter by mail,
7777 if the early voting ballot board determines that it would be
7878 possible to correct the defect and return the carrier envelope
7979 before the time the polls are required to close on election day; or
8080 (2) notify the voter of the defect by telephone or
8181 e-mail and inform the voter that the voter may request to have the
8282 voter's application to vote by mail canceled in the manner
8383 described by Section 84.032 or come to the early voting clerk's
8484 office in person not later than the sixth day after election day to
8585 correct the defect.
8686 (c) If the early voting ballot board takes an action
8787 described by Subsection (b), the board must take either action
8888 described by that subsection with respect to each ballot in the
8989 election to which this section applies.
9090 (d) A poll watcher is entitled to observe an action taken
9191 under Subsection (b).
9292 (e) The secretary of state may prescribe any procedures
9393 necessary to implement this section.
9494 (f) Notwithstanding any other law, a ballot may not be
9595 finally rejected for a reason listed in Section 87.041(b)(1), (2),
9696 or (6) before the seventh day after election day.
9797 SECTION 4. This Act takes effect on the 91st day after the
9898 last day of the legislative session.
