44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to an exception to the application of the offense of
77 illegal voting.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 64.012, Election Code, is amended by
1010 adding Subsection (c) to read as follows:
1111 (c) It is an exception to the application of Subsection
1212 (a)(1) that the person:
1313 (1) voted or attempted to vote a provisional ballot in
1414 accordance with Section 63.011; and
1515 (2) did not know:
1616 (A) of the particular circumstances that made the
1717 person not eligible to vote in the election; or
1818 (B) that those circumstances made the person not
1919 eligible to vote in the election.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect on the date the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense occurred
2727 before that date.
2828 SECTION 3. This Act takes effect September 1, 2021.
