66 AN ACT
77 relating to prohibited logistical support by a governmental entity
88 for procurement of an abortion or the services of an abortion
99 provider.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2273, Government Code, as redesignated
1212 by H.B. 3607, Acts of the 87th Legislature, Regular Session, 2021,
1313 and effective September 1, 2021, is amended by adding Section
1414 2273.0031 to read as follows:
1515 Sec. 2273.0031. LOGISTICAL SUPPORT PROHIBITED. (a) Except
1616 as provided by Subsection (b), a governmental entity may not enter
1717 into a taxpayer resource transaction or appropriate or spend money
1818 to provide to any person logistical support for the express purpose
1919 of assisting a woman with procuring an abortion or the services of
2020 an abortion provider. Logistical support includes providing money
2121 for:
2222 (1) child care;
2323 (2) travel or any form of transportation to or from an
2424 abortion provider;
2525 (3) lodging;
2626 (4) food or food preparation;
2727 (5) counseling that encourages a woman to have an
2828 abortion; and
2929 (6) any other service that facilitates the provision
3030 of an abortion.
3131 (b) This section does not apply to a taxpayer resource
3232 transaction entered into or money appropriated or spent by a
3333 governmental entity that is subject to a federal law in conflict
3434 with Subsection (a) as determined by the executive commissioner of
3535 the Health and Human Services Commission and confirmed in writing
3636 by the attorney general.
3737 SECTION 2. Section 2273.004(a), Government Code, as
3838 redesignated and amended by H.B. 3607, Acts of the 87th
3939 Legislature, Regular Session, 2021, and effective September 1,
4040 2021, is amended to read as follows:
4141 (a) The attorney general may bring an action in the name of
4242 the state to enjoin a violation of Section 2273.003 or 2273.0031.
4343 The attorney general may recover reasonable attorney's fees and
4444 costs incurred in bringing an action under this subsection.
4545 SECTION 3. It is the intent of the legislature that every
4646 provision, section, subsection, sentence, clause, phrase, or word
4747 in this Act, and every application of the provisions in this Act to
4848 each person or entity, are severable from each other. If any
4949 application of any provision in this Act to any person, group of
5050 persons, or circumstances is found by a court to be invalid for any
5151 reason, the remaining applications of that provision to all other
5252 persons and circumstances shall be severed and may not be affected.
5353 SECTION 4. This Act takes effect December 1, 2021.
