44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to charges imposed by a governmental body for providing
77 copies of campaign finance reports under the public information
88 law.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 552.261, Government Code, is amended by
1111 adding Subsection (f) to read as follows:
1212 (f) A governmental body may not impose a charge under this
1313 subchapter for providing a copy of public information if:
1414 (1) the information is a report required to be filed
1515 with the governmental body under Subchapter C or D, Chapter 254,
1616 Election Code, unless all of those reports filed with the
1717 governmental body during the preceding three years are available to
1818 the public on the governmental body's Internet website;
1919 (2) the governmental body fails to disclose the
2020 information on or before the 10th business day after the date of
2121 receiving the requestor's written request, unless the governmental
2222 body:
2323 (A) sends a written request for clarification
2424 under Section 552.222(b); or
2525 (B) requests a decision from the attorney general
2626 under Section 552.301; or
2727 (3) the governmental body requests a decision from the
2828 attorney general under Section 552.301 and:
2929 (A) the governmental body fails to comply with
3030 Subsection (d) of that section; or
3131 (B) the attorney general determines the
3232 requested information must be disclosed.
3333 SECTION 2. The changes in law made by this Act apply only to
3434 a request for public information received by a governmental body or
3535 officer for public information on or after the effective date of
3636 this Act.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect on the 91st day after the last day of the
4242 legislative session.
