| 7 | 7 | | relating to an acute psychiatric bed registry to list available |

| 8 | 8 | | beds for the psychiatric treatment of certain individuals. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.0997 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.0997. ACUTE PSYCHIATRIC BED REGISTRY. (a) In this |
|---|
| 13 | 13 | | section, "inpatient mental health facility" has the meaning |
|---|
| 14 | 14 | | assigned by Section 571.003, Health and Safety Code. |
|---|
| 15 | 15 | | (b) The commission shall develop and administer an |
|---|
| 16 | 16 | | Internet-based and searchable acute psychiatric bed registry to |
|---|
| 17 | 17 | | collect, aggregate, and display information about beds at inpatient |
|---|
| 18 | 18 | | mental health facilities that are available for the inpatient |
|---|
| 19 | 19 | | psychiatric treatment of individuals. |
|---|
| 20 | 20 | | (c) For each inpatient mental health facility, the acute |
|---|
| 21 | 21 | | psychiatric bed registry must list: |
|---|
| 22 | 22 | | (1) the name and contact information of the facility; |
|---|
| 23 | 23 | | (2) the number of available beds; |
|---|
| 24 | 24 | | (3) the type of individual who may be admitted; |
|---|
| 25 | 25 | | (4) the level of security provided; and |
|---|
| 26 | 26 | | (5) any other information that may be necessary to |
|---|
| 27 | 27 | | identify appropriate beds for the inpatient psychiatric treatment |
|---|
| 28 | 28 | | of individuals. |
|---|
| 29 | 29 | | (d) The commission shall make the acute psychiatric bed |
|---|
| 30 | 30 | | registry available to law enforcement agencies, community service |
|---|
| 31 | 31 | | boards, mental health facilities, public and private residential |
|---|
| 32 | 32 | | crisis stabilization units, emergency care facilities, and |
|---|
| 33 | 33 | | emergency care providers. The commission may make the registry |
|---|
| 34 | 34 | | available to any other person the commission considers appropriate. |
|---|
| 35 | 35 | | (e) An inpatient mental health facility shall submit to the |
|---|
| 36 | 36 | | commission information for the acute psychiatric bed registry as |
|---|
| 37 | 37 | | required by the commission and review the information and confirm |
|---|
| 38 | 38 | | its accuracy to the commission at least once daily and whenever |
|---|
| 39 | 39 | | there is a change in bed availability at the facility. |
|---|
| 40 | 40 | | (f) An inpatient mental health facility shall designate an |
|---|
| 41 | 41 | | employee or employees as necessary to: |
|---|
| 42 | 42 | | (1) submit to the commission the information required |
|---|
| 43 | 43 | | under Subsection (e) and review the information as required by that |
|---|
| 44 | 44 | | subsection; and |
|---|
| 45 | 45 | | (2) serve as a contact for questions about the |
|---|
| 46 | 46 | | information submitted. |
|---|
| 47 | 47 | | (g) The commission may contract with any person the |
|---|
| 48 | 48 | | commission considers appropriate to develop and administer the |
|---|
| 49 | 49 | | acute psychiatric bed registry. |
|---|
| 50 | 50 | | (h) The commission may accept gifts, grants, or donations |
|---|
| 51 | 51 | | from any public or private source for the purpose of carrying out |
|---|
| 52 | 52 | | this section. |
|---|
| 53 | 53 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 54 | 54 | | of this Act, the Health and Human Services Commission shall |
|---|
| 55 | 55 | | establish the acute psychiatric bed registry required by Section |
|---|
| 56 | 56 | | 531.0997, Government Code, as added by this Act. |
|---|
| 57 | 57 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 58 | 58 | | last day of the legislative session. |
