| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 129.051, Election Code, is amended by | |
| 10 | 10 | amending Subsection (b) and adding Subsection (h) to read as | |
| 11 | 11 | follows: | |
| 12 | 12 | (b) The general custodian of election records shall develop | |
| 13 | 13 | a procedure for tracking the custody of each electronic information | |
| 14 | 14 | storage medium from its storage location, through election coding | |
| 15 | 15 | and the election process, to its final post-election disposition | |
| 16 | 16 | and return to storage. The chain of custody must require two or | |
| 17 | 17 | more individuals to perform a check and verification check whenever | |
| 18 | 18 | a transfer of custody occurs, and must include the maintenance of a | |
| 19 | 19 | log signed by the individuals and containing the serial number or | |
| 20 | 20 | other unique identifier of the medium. | |
| 21 | 21 | (h) The secretary of state shall create a standard form for | |
| 22 | 22 | maintaining the log under Subsection (b). | |
| 23 | 23 | SECTION 2. This Act takes effect on the 91st day after the | |
| 24 | 24 | last day of the legislative session. |
