8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter F, Chapter 301, Government Code, is | |
10 | 10 | amended by adding Section 301.074 to read as follows: | |
11 | 11 | Sec. 301.074. VACANCY DUE TO EXCESSIVE ABSENCE. A member of | |
12 | 12 | the legislature vacates the member's office if the member is absent | |
13 | 13 | from all proceedings of the house of the legislature of which the | |
14 | 14 | person is a member, without a leave of absence granted by that | |
15 | 15 | house, for 14 consecutive days on which that house meets. | |
16 | 16 | SECTION 2. Section 301.074, Government Code, as added by | |
17 | 17 | this Act, applies only to an absence that occurs on or after the | |
18 | 18 | effective date of this Act. | |
19 | 19 | SECTION 3. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect on the 91st day after the last day of the | |
24 | 24 | legislative session. |
