| 7 | 7 | | relating to providing notice to a parent or guardian regarding a |

| 8 | 8 | | positive coronavirus disease (COVID-19) test of a person assigned |
|---|
| 9 | 9 | | to a student's classroom. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 38.0311 to read as follows: |
|---|
| 13 | 13 | | Sec. 38.0311. NOTICE OF CORONAVIRUS DISEASE (COVID-19). |
|---|
| 14 | 14 | | (a) The board of trustees of a school district or the governing |
|---|
| 15 | 15 | | body of an open-enrollment charter school shall adopt a policy |
|---|
| 16 | 16 | | requiring the district or school to provide written or electronic |
|---|
| 17 | 17 | | notice to the parent or guardian of each student assigned to a |
|---|
| 18 | 18 | | classroom in which a student or educator has tested positive for the |
|---|
| 19 | 19 | | coronavirus disease (COVID-19). Notice required under this section |
|---|
| 20 | 20 | | shall be made as soon as practicable after the district or school |
|---|
| 21 | 21 | | becomes aware the student or educator is infected. The notice: |
|---|
| 22 | 22 | | (1) must include the recommendations of the Centers |
|---|
| 23 | 23 | | for Disease Control and Prevention for the treatment and prevention |
|---|
| 24 | 24 | | of the spread of the coronavirus disease (COVID-19); and |
|---|
| 25 | 25 | | (2) may not identify the student or educator who |
|---|
| 26 | 26 | | tested positive for the coronavirus disease (COVID-19). |
|---|
| 27 | 27 | | (b) The commissioner may adopt rules as necessary to |
|---|
| 28 | 28 | | implement this section. |
|---|
| 29 | 29 | | SECTION 2. This Act applies beginning with the 2021-2022 |
|---|
| 30 | 30 | | school year. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect on the 91st day after the last day of the |
|---|
| 36 | 36 | | legislative session. |
