66 AN ACT
77 relating to providing notice to a parent or guardian regarding a
88 positive coronavirus disease (COVID-19) test of a person assigned
99 to a student's classroom.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1212 amended by adding Section 38.0311 to read as follows:
1313 Sec. 38.0311. NOTICE OF CORONAVIRUS DISEASE (COVID-19).
1414 (a) The board of trustees of a school district or the governing
1515 body of an open-enrollment charter school shall adopt a policy
1616 requiring the district or school to provide written or electronic
1717 notice to the parent or guardian of each student assigned to a
1818 classroom in which a student or educator has tested positive for the
1919 coronavirus disease (COVID-19). Notice required under this section
2020 shall be made as soon as practicable after the district or school
2121 becomes aware the student or educator is infected. The notice:
2222 (1) must include the recommendations of the Centers
2323 for Disease Control and Prevention for the treatment and prevention
2424 of the spread of the coronavirus disease (COVID-19); and
2525 (2) may not identify the student or educator who
2626 tested positive for the coronavirus disease (COVID-19).
2727 (b) The commissioner may adopt rules as necessary to
2828 implement this section.
2929 SECTION 2. This Act applies beginning with the 2021-2022
3030 school year.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect on the 91st day after the last day of the
3636 legislative session.
