5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to vehicle safety inspections for vehicles registered in
8	8	certain counties; imposing a fee.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 382.0622(a), Health and Safety Code, is
11	11	amended to read as follows:
12	12	(a) Clean Air Act fees consist of:
13	13	(1) fees collected by the commission under Sections
14	14	382.062, 382.0621, 382.202, and 382.302 and as otherwise provided
15	15	by law;
16	16	(2) $2 from the portion of each fee collected for
17	17	inspections of vehicles other than mopeds and remitted to the state
18	18	under Sections 548.501 and 548.503, Transportation Code; [and]
19	19	(3) $6 from the portion of each fee collected for
20	20	inspections of vehicles other than mopeds and remitted to the state
21	21	under Section 548.5035, Transportation Code; and
22	22	(4) fees collected that are required under Section 185
23	23	of the federal Clean Air Act (42 U.S.C. Section 7511d).
24	24	SECTION 2. Subchapter A, Chapter 548, Transportation Code,
25	25	is amended by adding Section 548.010 to read as follows:
26	26	Sec. 548.010. INSPECTION IN ANY COUNTY PERMITTED FOR
27	27	VEHICLES REGISTERED IN CERTAIN COUNTIES. Notwithstanding any other
28	28	law, a vehicle inspected under Section 548.1025 may be inspected in
29	29	any county.
30	30	SECTION 3. Section 548.101, Transportation Code, is amended
31	31	to read as follows:
32	32	Sec. 548.101. GENERAL ONE-YEAR INSPECTION PERIOD. Except
33	33	as provided by Sections [Section] 548.102 and 548.1025, the
34	34	department shall require an annual inspection. The department
35	35	shall set the periods of inspection and may make rules with respect
36	36	to those periods. The rules must provide that:
37	37	(1) a vehicle owner shall [may] obtain any required
38	38	inspections [an inspection] not earlier than 90 days before the
39	39	date of expiration of the vehicle's registration; and
40	40	(2) a used motor vehicle sold by a dealer, as defined
41	41	by Section 503.001, must be inspected in the 180 days preceding the
42	42	date the dealer sells the vehicle.
43	43	SECTION 4. Section 548.102(a), Transportation Code, is
44	44	amended to read as follows:
45	45	(a) Except as provided by Section 548.1025, the [The]
46	46	initial inspection period is two years for a passenger car or light
47	47	truck that:
48	48	(1) is sold in this state or purchased by a commercial
49	49	fleet buyer described by Section 501.0234(b)(4) for use in this
50	50	state;
51	51	(2) has not been previously registered in this or
52	52	another state; and
53	53	(3) on the date of sale is of the current or preceding
54	54	model year.
55	55	SECTION 5. Subchapter C, Chapter 548, Transportation Code,
56	56	is amended by adding Section 548.1025 to read as follows:
57	57	Sec. 548.1025. INSPECTION PERIOD FOR VEHICLES REGISTERED IN
58	58	CERTAIN COUNTIES. (a) This section applies only to a vehicle that
59	59	is registered in a county that has:
60	60	(1) a population of less than 10,000; and
61	61	(2) a total area of more than 2,000 square miles.
62	62	(b) The inspection period for a vehicle described by
63	63	Subsection (a) is three years.
64	64	(c) This section does not apply to the inspection period for
65	65	a:
66	66	(1) commercial motor vehicle inspection under
67	67	Subchapter D; or
68	68	(2) motor vehicle emissions inspection under
69	69	Subchapter F.
70	70	SECTION 6. Section 548.254, Transportation Code, is amended
71	71	to read as follows:
72	72	Sec. 548.254. VALIDITY OF VEHICLE INSPECTION REPORT. The
73	73	department, and the conservation commission if necessary, by rule
74	74	shall establish the length of time a [A] vehicle inspection report
75	75	required by this chapter is valid [invalid after the end of the 12th
76	76	month following the month in which the report is issued].
77	77	SECTION 7. Section 548.501(a), Transportation Code, is
78	78	amended to read as follows:
79	79	(a) Except as provided by Sections 548.503, 548.5035, and
80	80	548.504, the fee for inspection of a motor vehicle other than a
81	81	moped is $12.50. The fee for inspection of a moped is $5.75.
82	82	SECTION 8. Subchapter H, Chapter 548, Transportation Code,
83	83	is amended by adding Section 548.5035 to read as follows:
84	84	Sec. 548.5035. FEE FOR THREE-YEAR INSPECTION OF VEHICLES
85	85	REGISTERED IN CERTAIN COUNTIES. (a) Except as provided by
86	86	Subsection (b), the fee for inspection of a vehicle under Section
87	87	548.1025 is $23.50.
88	88	(b) The fee for inspection of a moped under Section 548.1025
89	89	is $16.75.
90	90	(c) Out of each fee for an inspection, $16.50 shall be
91	91	remitted to the state under Section 548.509.
92	92	SECTION 9. Section 548.505(a), Transportation Code, is
93	93	amended to read as follows:
94	94	(a) The department by rule may impose an inspection fee for
95	95	a vehicle inspected under Section 548.301(a) in addition to the fee
96	96	provided by Section 548.501, 548.502, 548.503, 548.5035, or
97	97	548.504. A fee imposed under this subsection must be based on the
98	98	costs of:
99	99	(1) providing inspections; and
100	100	(2) administering the program.
101	101	SECTION 10. Not later than April 1, 2022, the Texas
102	102	Department of Motor Vehicles shall adopt rules and update the
103	103	department's registration database and system as necessary to
104	104	ensure that an owner of a vehicle subject to Section 548.010,
105	105	Transportation Code, as added by this Act, is able to register or
106	106	renew registration of the vehicle without obtaining an annual
107	107	safety inspection of the vehicle.
108	108	SECTION 11. (a) Except as provided by Subsection (b) of this
109	109	section, this Act takes effect May 1, 2022.
110	110	(b) Section 10 of this Act takes effect January 1, 2022.
