55 AN ACT
66 relating to notifications given to a person convicted of a felony
77 concerning the person's eligibility to vote.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 42.03, Code of Criminal Procedure, is
1010 amended by adding Section 6 to read as follows:
1111 Sec. 6. The court after pronouncing the sentence of a
1212 defendant convicted of a felony shall inform the defendant, in
1313 writing using clear language, of how the felony conviction will
1414 impact the defendant's right to vote in this state.
1515 SECTION 2. Subchapter B, Chapter 15, Election Code, is
1616 amended by adding Section 15.029 to read as follows:
1717 Sec. 15.029. NOTIFICATION OF REGISTRATION ELIGIBILITY BY
1818 SECRETARY OF STATE. (a) This section applies to a person who is
1919 ineligible to vote in this state under Section 13.001(a)(4) because
2020 the person was finally convicted of a felony.
2121 (b) The secretary of state shall coordinate with the Texas
2222 Department of Criminal Justice, the Department of Public Safety,
2323 and any other relevant agency to determine when a person to whom
2424 this section applies has regained eligibility to vote in accordance
2525 with Section 13.001(a)(4)(A) or (B).
2626 (c) At the time a person to whom this section applies
2727 regains eligibility to vote, the secretary of state shall use best
2828 efforts to provide the person with:
2929 (1) a notice informing the person in plain language
3030 that the person may be eligible to register to vote, including
3131 instructions for registration; and
3232 (2) a voter registration application.
3333 (d) The secretary of state shall post on the secretary's
3434 Internet website a generic version of the notice described by
3535 Subsection (c)(1).
3636 (e) The secretary of state shall adopt rules as necessary to
3737 administer this section.
3838 SECTION 3. This Act takes effect on the 91st day after the
3939 last day of the legislative session.
