44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the storage of radioactive waste or elemental mercury
77 for any period exceeding one year; authorizing a fee.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 401.244, Health and Safety Code, is
1010 amended by adding Subsection (a-1) to read as follows:
1111 (a-1) A holder of a license or permit issued by the
1212 commission under this chapter or Chapter 361 that authorizes the
1313 storage, other than disposal, of a radioactive waste or elemental
1414 mercury from other persons shall remit each quarter to the
1515 commissioners court of the host county five percent of the license
1616 or permit holder's gross receipts received from the storage of a
1717 radioactive waste or elemental mercury for any period exceeding one
1818 year. This subsection applies only to the storage of the substance
1919 for any period exceeding one year. This subsection applies only to
2020 the storage of radioactive waste or elemental mercury at or
2121 adjacent to the compact waste disposal facility.
2222 SECTION 2. Sec. 401.271(a), Health and Safety Code, is
2323 amended to read as follows:
2424 (a) A holder of a license issued by the commission under
2525 this chapter that authorizes the disposal of a radioactive
2626 substance from other persons shall remit each quarter an amount
2727 equal to 10 percent of the license holder's gross receipts received
2828 from disposal operations under a license issued under this chapter
2929 that occur after the effective date of the Act enacting this section
3030 as follows:
3131 (1) five percent shall be remitted to the comptroller
3232 for deposit to the credit of the general revenue fund; and
3333 (2) five percent shall be remitted to the host county
3434 in accordance with Section [Sections] 401.244[(b) and (d)].
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect on the 91st day after the last day of the
4040 legislative session.
