66 AN ACT
77 relating to a prohibition on certain companies that receive
88 government contracts from requiring employees to receive a
99 vaccination.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 10, Government Code, is
1212 amended by adding Chapter 2275 to read as follows:
1313 CHAPTER 2275. MANDATORY VACCINATIONS PROHIBITED
1414 Sec. 2275.001. DEFINITIONS. In this chapter:
1515 (1) "Company" has the meaning assigned by Section
1616 808.001.
1717 (2) "Political subdivision" means a county,
1818 municipality, school district, special purpose district, or other
1919 subdivision of state government that has jurisdiction limited to a
2020 geographic portion of the state.
2121 (3) "State agency" has the meaning assigned by Section
2222 609.001.
2323 Sec. 2275.002. PROVISION REQUIRED IN CONTRACT. A state
2424 agency or political subdivision may not enter into a contract with a
2525 company for goods or services unless the contract contains a
2626 written verification from the company that it does not, and will not
2727 during the term of the contract, require, as a condition of
2828 employment, an employee to receive any vaccination.
2929 SECTION 2. Chapter 2275, Government Code, as added by this
3030 Act, applies only to a contract entered into on or after the
3131 effective date of this Act. A contract entered into before that
3232 date is governed by the law in effect on the date the contract was
3333 entered into, and the former law is continued in effect for that
3434 purpose.
3535 SECTION 3. This Act takes effect on the 91st day after the
3636 last day of the legislative session.
