| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Title 16, Election Code, is amended by adding |
|---|
| 10 | 10 | | Chapter 280 to read as follows: |

| 11 | 11 | | CHAPTER 280. FORENSIC AUDIT OF 2020 GENERAL ELECTION |

| 12 | 12 | | Sec. 280.001. FORENSIC AUDIT OF 2020 GENERAL ELECTION. (a) |
|---|
| 13 | 13 | | The governor, lieutenant governor, and speaker of the house of |
|---|
| 14 | 14 | | representatives shall appoint an independent third party to conduct |
|---|
| 15 | 15 | | a forensic audit of the general election that took place on November |
|---|
| 16 | 16 | | 3, 2020. |
|---|
| 17 | 17 | | (b) The independent third party appointed under Subsection |
|---|
| 18 | 18 | | (a) shall audit every precinct in each county with a population of |
|---|
| 19 | 19 | | 415,000 or more. |
|---|
| 20 | 20 | | (c) The audit under this section must begin not later than |
|---|
| 21 | 21 | | November 1, 2021, and be completed not later than February 1, 2022. |
|---|
| 22 | 22 | | (d) Not later than March 1, 2022, the independent third |
|---|
| 23 | 23 | | party conducting the audit under this section shall submit a report |
|---|
| 24 | 24 | | to the governor, lieutenant governor, speaker of the house of |
|---|
| 25 | 25 | | representatives, and each member of the legislature detailing any |
|---|
| 26 | 26 | | anomalies or discrepancies in voter data, ballot data, or |
|---|
| 27 | 27 | | tabulation. |
|---|
| 28 | 28 | | (e) This chapter expires April 1, 2022. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect on the 91st day after the last day of the |
|---|
| 34 | 34 | | legislative session. |
