9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 30, Penal Code, is amended by adding | |
11 | 11 | Section 30.055 to read as follows: | |
12 | 12 | Sec. 30.055. TRESPASS WHILE ENTERING THE STATE. (a) A | |
13 | 13 | person commits an offense if the person enters or remains on or in | |
14 | 14 | property of another, without the effective consent of the owner, | |
15 | 15 | while entering this state from a neighboring jurisdiction. | |
16 | 16 | (b) An offense under this section is a Class B misdemeanor, | |
17 | 17 | except that the offense is a Class A misdemeanor if it is shown on | |
18 | 18 | the trial of the offense that the defendant has previously been | |
19 | 19 | convicted of an offense under this section. | |
20 | 20 | (c) If conduct that constitutes an offense under this | |
21 | 21 | section also constitutes an offense under another law, the actor | |
22 | 22 | may be prosecuted under this section, the other law, or both. | |
23 | 23 | (d) The attorney general has concurrent jurisdiction with | |
24 | 24 | the appropriate local county or district attorney to prosecute an | |
25 | 25 | offense under this section. | |
26 | 26 | SECTION 2. This Act takes effect on the 91st day after the | |
27 | 27 | last day of the legislative session. |
