55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the criminal offense of trespass while
88 entering the state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 30, Penal Code, is amended by adding
1111 Section 30.055 to read as follows:
1212 Sec. 30.055. TRESPASS WHILE ENTERING THE STATE. (a) A
1313 person commits an offense if the person enters or remains on or in
1414 property of another, without the effective consent of the owner,
1515 while entering this state from a neighboring jurisdiction.
1616 (b) An offense under this section is a Class B misdemeanor,
1717 except that the offense is a Class A misdemeanor if it is shown on
1818 the trial of the offense that the defendant has previously been
1919 convicted of an offense under this section.
2020 (c) If conduct that constitutes an offense under this
2121 section also constitutes an offense under another law, the actor
2222 may be prosecuted under this section, the other law, or both.
2323 (d) The attorney general has concurrent jurisdiction with
2424 the appropriate local county or district attorney to prosecute an
2525 offense under this section.
2626 SECTION 2. This Act takes effect on the 91st day after the
2727 last day of the legislative session.
