44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prohibiting certain instruction in public schools.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 28, Education Code, is
99 amended by adding Section 28.0025 to read as follows:
1010 Sec. 28.0025. CERTAIN INSTRUCTION PROHIBITED. A school
1111 district or open-enrollment charter school may not offer a course,
1212 component of a course, unit of study, or other instruction that
1313 directs or otherwise compels a student to personally affirm, adopt,
1414 or adhere to the idea that:
1515 (1) any race, sex, ethnicity, religion, color, or
1616 national origin is inherently superior or inferior to another race,
1717 sex, ethnicity, religion, color, or national origin;
1818 (2) an individual should be discriminated against or
1919 receive adverse treatment solely or partly because of the
2020 individual's race, sex, ethnicity, religion, color, or national
2121 origin; or
2222 (3) an individual, by virtue of the individual's race,
2323 sex, ethnicity, religion, color, or national origin, is inherently
2424 responsible for actions committed in the past by other members of
2525 the same race, sex, ethnicity, religion, color, or national origin.
2626 SECTION 2. This Act applies beginning with the 2021-2022
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect on the 91st day after the last day of the
3333 legislative session.
