| 7 | 7 | | relating to prohibiting the use of state or federal money for the |

| 8 | 8 | | purpose of certain instruction at public institutions of higher |
|---|
| 9 | 9 | | education. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 51.979 to read as follows: |
|---|
| 13 | 13 | | Sec. 51.979. USE OF STATE OR FEDERAL MONEY PROHIBITED FOR |
|---|
| 14 | 14 | | CERTAIN INSTRUCTION. (a) In this section, "institution of higher |
|---|
| 15 | 15 | | education" has the meaning assigned by Section 61.003. |
|---|
| 16 | 16 | | (b) Notwithstanding any other law, an institution of higher |
|---|
| 17 | 17 | | education may not use appropriated state or federal money to offer a |
|---|
| 18 | 18 | | course, component of a course, unit of study, or other instruction |
|---|
| 19 | 19 | | that directs or otherwise compels a student to personally affirm, |
|---|
| 20 | 20 | | adopt, or adhere to the idea that: |
|---|
| 21 | 21 | | (1) any race, sex, ethnicity, religion, color, or |
|---|
| 22 | 22 | | national origin is inherently superior or inferior to another race, |
|---|
| 23 | 23 | | sex, ethnicity, religion, color, or national origin; |
|---|
| 24 | 24 | | (2) an individual should be discriminated against or |
|---|
| 25 | 25 | | receive adverse treatment solely or partly because of the |
|---|
| 26 | 26 | | individual's race, sex, ethnicity, religion, color, or national |
|---|
| 27 | 27 | | origin; or |
|---|
| 28 | 28 | | (3) an individual, by virtue of the individual's race, |
|---|
| 29 | 29 | | sex, ethnicity, religion, color, or national origin, is inherently |
|---|
| 30 | 30 | | responsible for actions committed in the past by other members of |
|---|
| 31 | 31 | | the same race, sex, ethnicity, religion, color, or national origin. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2022 spring |
|---|
| 33 | 33 | | semester. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect on the 91st day after the last day of the |
|---|
| 39 | 39 | | legislative session. |
