55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting the use of state or federal money for the
88 purpose of certain instruction at public institutions of higher
99 education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1212 amended by adding Section 51.979 to read as follows:
1313 Sec. 51.979. USE OF STATE OR FEDERAL MONEY PROHIBITED FOR
1414 CERTAIN INSTRUCTION. (a) In this section, "institution of higher
1515 education" has the meaning assigned by Section 61.003.
1616 (b) Notwithstanding any other law, an institution of higher
1717 education may not use appropriated state or federal money to offer a
1818 course, component of a course, unit of study, or other instruction
1919 that directs or otherwise compels a student to personally affirm,
2020 adopt, or adhere to the idea that:
2121 (1) any race, sex, ethnicity, religion, color, or
2222 national origin is inherently superior or inferior to another race,
2323 sex, ethnicity, religion, color, or national origin;
2424 (2) an individual should be discriminated against or
2525 receive adverse treatment solely or partly because of the
2626 individual's race, sex, ethnicity, religion, color, or national
2727 origin; or
2828 (3) an individual, by virtue of the individual's race,
2929 sex, ethnicity, religion, color, or national origin, is inherently
3030 responsible for actions committed in the past by other members of
3131 the same race, sex, ethnicity, religion, color, or national origin.
3232 SECTION 2. This Act applies beginning with the 2022 spring
3333 semester.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect on the 91st day after the last day of the
3939 legislative session.
