66 AN ACT
77 relating to electronic voter registration and electronic
88 submission of an application for an early voting ballot by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1111 amended by adding Section 13.009 to read as follows:
1212 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1313 secretary of state shall implement a program to allow a person to
1414 complete a voter registration application over the Internet from
1515 the official website of this state. The websites of the secretary
1616 of state and the Department of Public Safety must also provide a
1717 link to the location of the application on the official website of
1818 this state.
1919 (b) An applicant for electronic voter registration who has a
2020 driver's license or personal identification card issued in this
2121 state, regardless of whether the license or card is unexpired,
2222 must:
2323 (1) attest to the truth of the information provided on
2424 the application by affirmatively accepting the information as true;
2525 and
2626 (2) affirmatively consent to the use of the signature
2727 on the applicant's driver's license or personal identification card
2828 for voter registration purposes.
2929 (c) An applicant for electronic voter registration who does
3030 not have a driver's license or personal identification card issued
3131 in this state must:
3232 (1) attest to the truth of the information provided on
3333 the application by affirmatively accepting the information as true;
3434 and
3535 (2) print a registration application from the website
3636 the applicant is using to register, sign the application, and mail
3737 it to the registrar.
3838 (d) For each application submitted under Subsection (b),
3939 the program must require that a digital copy of the applicant's
4040 signature be obtained from the Department of Public Safety.
4141 (e) For each application submitted under Subsection (c),
4242 the program must provide the applicant with:
4343 (1) a registration application that the applicant can
4444 print from the registration website, sign, and mail to the
4545 registrar as required under Subsection (c)(2); and
4646 (2) information about how the applicant can obtain a
4747 driver's license or personal identification card from the
4848 Department of Public Safety.
4949 (f) An application submitted under this section is
5050 considered for all purposes an application submitted by mail under
5151 this title.
5252 (g) The secretary of state shall adopt rules as necessary to
5353 implement this section, including rules to provide for additional
5454 security measures necessary to ensure the accuracy and integrity of
5555 applications submitted electronically.
5656 (h) The rules adopted under Subsection (g) must require
5757 that:
5858 (1) the Internet website through which a person may
5959 complete a voter registration application include a description of
6060 the offense described by Section 13.007 in a conspicuous location
6161 on the website near the place where the person begins or submits the
6262 application; and
6363 (2) the state electronic Internet portal project be
6464 used to authenticate the identity of a person who submits an
6565 application electronically under this section.
6666 SECTION 2. Sections 84.001(b) and (d), Election Code, are
6767 amended to read as follows:
6868 (b) An application must be in writing and signed by the
6969 applicant. Except as provided by Section 84.0091, an [An]
7070 electronic signature is not permitted.
7171 (d) An application must be submitted [by mail] to the early
7272 voting clerk for the election who serves the election precinct of
7373 the applicant's residence.
7474 SECTION 3. Section 84.007(a), Election Code, is amended to
7575 read as follows:
7676 (a) Except as provided by Sections 84.008, [and] 84.009, and
7777 84.0091, an application for a ballot to be voted by mail must be
7878 submitted as provided by this section.
7979 SECTION 4. Subchapter A, Chapter 84, Election Code, is
8080 amended by adding Section 84.0091 to read as follows:
8181 Sec. 84.0091. SUBMITTING APPLICATION FOR BALLOT VOTED BY
8282 MAIL: ELECTRONIC SUBMISSION. The secretary of state shall
8383 implement a program to allow a person to complete an application for
8484 an early voting ballot by mail over the Internet from the official
8585 website of this state. The program must:
8686 (1) permit an applicant to electronically sign the
8787 application;
8888 (2) deliver a completed application to the early
8989 voting clerk for the election who serves the election precinct of
9090 the applicant's residence; and
9191 (3) permit an applicant to check the status of the
9292 applicant's application.
9393 SECTION 5. This Act takes effect on the 91st day after the
9494 last day of the legislative session.
