66 AN ACT
77 relating to the registration of voters at a polling place and
88 related procedures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 12, Election Code, is
1111 amended by adding Section 12.007 to read as follows:
1212 Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER
1313 REGISTRARS. An election officer serving a polling place for early
1414 voting by personal appearance is a deputy voter registrar and has
1515 the same authority as a regular deputy registrar.
1616 SECTION 2. Chapter 62, Election Code, is amended by adding
1717 Section 62.0015 to read as follows:
1818 Sec. 62.0015. VOTER REGISTRARS MUST BE PRESENT. Two voter
1919 registrars must be present at each polling place while the polls are
2020 open.
2121 SECTION 3. Chapter 63, Election Code, is amended by adding
2222 Section 63.010 to read as follows:
2323 Sec. 63.010. REGISTRATION AT POLLING PLACE. (a) A person
2424 who would be eligible to vote in an election under Section 11.001,
2525 but for the requirement to be a registered voter, shall be accepted
2626 during voting by personal appearance for voting the ballot for the
2727 precinct of the person's residence as shown by the identification
2828 presented if, on the day the person offers to vote, the person:
2929 (1) submits a voter registration application that
3030 complies with Section 13.002 to an election officer at the polling
3131 place; and
3232 (2) presents as proof of residence a form of photo
3333 identification described by Section 63.0101(a) that states the
3434 person's current address.
3535 (b) The election officer shall return the original proof of
3636 residence to the voter.
3737 (c) A person voting under this section shall vote a
3838 provisional ballot in the manner provided by Section 63.011 except
3939 that the person is not required to submit the affidavit under
4040 Section 63.011(a).
4141 (d) For each registration corresponding to a ballot cast
4242 under this section, the voter registrar shall review the
4343 application and determine whether the applicant is eligible for
4444 registration as provided by Subchapter C, Chapter 13. A
4545 registration approved under this subsection takes effect on the
4646 date the vote was cast.
4747 (e) The secretary of state may by rule prescribe procedures
4848 to implement this section.
4949 SECTION 4. Section 85.031(a), Election Code, is amended to
5050 read as follows:
5151 (a) For each person entitled to vote an early voting ballot
5252 by personal appearance or entitled to register at a polling place,
5353 the early voting clerk shall follow the procedure for accepting or
5454 registering a regular voter on election day, with the modifications
5555 necessary for the conduct of early voting.
5656 SECTION 5. This Act takes effect on the 91st day after the
5757 last day of the legislative session.
