55 CONCURRENT RESOLUTION
66 WHEREAS, The State of Texas and the United States federal
77 government are charged with protecting 1,254 miles of land along
88 Texas' border with Mexico, a job that has become increasingly
99 violent as this state has succumbed to a foreign drug
1010 cartel-facilitated invasion; and
1111 WHEREAS, These foreign drug cartels bring terror to Texas
1212 communities by flooding the streets with deadly narcotics, forcing
1313 women and children into human and sex trafficking, enriching
1414 themselves on the misery and enslavement of Texans, and butchering
1515 and murdering anyone who tries to stop them; and
1616 WHEREAS, In fiscal year 2021, U.S. Customs and Border
1717 Protection reports over 200,000 pounds of illegal narcotics have
1818 been seized from foreign drug cartels in Texas; and
1919 WHEREAS, Specifically, federal seizures of fentanyl in Texas
2020 have dramatically increased by more than 950 percent this fiscal
2121 year; and
2222 WHEREAS, In fiscal year 2021, the U.S. Border Patrol has
2323 already arrested more than 7,800 noncitizens that were determined
2424 to have prior criminal records; and
2525 WHEREAS, The Office of the Texas Attorney General estimates
2626 that there are 234,000 victims of labor trafficking and 79,000
2727 victims of youth and minor sex trafficking at any given time in
2828 Texas; and
2929 WHEREAS, State and local law enforcement agencies are forced
3030 to contend with extensive and dangerous criminal activity resulting
3131 from, or associated with, foreign drug cartels, thereby putting
3232 Texas law enforcement officials in danger and draining resources
3333 away from protecting our communities; and
3434 WHEREAS, The State of Texas has attempted to address the
3535 problem by adding hundreds of commissioned law enforcement officers
3636 to the border, purchasing state-of-the-art helicopters, conducting
3737 border security surge operations, and paying millions of dollars
3838 for overtime, training, equipment, and technology for local law
3939 enforcement; and
4040 WHEREAS, Law enforcement agencies working together in Texas
4141 have seized billions of dollars in illegal drugs and hundreds of
4242 millions in cash, along with thousands of firearms and weapons, all
4343 related to the foreign drug cartel-facilitated invasion; and
4444 WHEREAS, Texas has repeatedly asked the federal government to
4545 send more border security resources to the state, requesting an
4646 increase in manpower of border patrol agents and the deployment of
4747 National Guard troops; and
4848 WHEREAS, Texas prisons house thousands of violent offenders
4949 that claim foreign citizenship, and the state bears the cost of
5050 housing and prosecuting those offenders; and
5151 WHEREAS, Texas taxpayers have spent billions compensating
5252 for the lack of federal resources provided to the state; and
5353 WHEREAS, The unwillingness of the federal government to
5454 develop a comprehensive plan that would address this border
5555 security problem puts an unfair and unreasonable burden on the
5656 entire state, but in particular on Texas border communities; and
5757 WHEREAS, The federal government has failed to protect the
5858 State of Texas from this foreign drug cartel-facilitated invasion
5959 as required by Article IV, Section 4 of the United States
6060 Constitution; and
6161 WHEREAS, Under Article I, Section 10 of the United States
6262 Constitution, Texas is entitled as a sovereign state of the United
6363 States of America to protect itself against this current foreign
6464 drug cartel-facilitated invasion, which grants the State of Texas
6565 the power to defend the state when the state has been invaded, or is
6666 "in such imminent Danger as will not admit of delay"; now,
6767 therefore, be it
6868 RESOLVED, That the 87th Legislature of the State of Texas,
6969 2nd Called Session, hereby respectfully request the federal
7070 government to immediately declare violent foreign drug cartels as
7171 foreign terrorist organizations under Section 219 of the
7272 Immigration and Nationality Act, 8 U.S.C. ยง 1189; and, be it further
7373 RESOLVED, That the Texas Legislature hereby find that foreign
7474 drug cartels have facilitated an invasion of the State of Texas and
7575 that the citizens of this state are in danger of irreparable harm;
7676 and, be it further
7777 RESOLVED, That the Texas Legislature hereby encourage the
7878 Texas Military Department and all applicable state resources as
7979 needed to use any and all authority under Article I, Section 10 of
8080 the United States Constitution to repel this violent foreign drug
8181 cartel-facilitated invasion, and that such authority should be
8282 invoked as the authorization for use of military force with the
8383 intention of utilizing such authority in the least lethal manner
8484 possible consistent with bringing this facilitated invasion to a
8585 conclusion at the earliest possible moment.
