6 | 6 | | WHEREAS, The State of Texas and the United States federal |
---|
7 | 7 | | government are charged with protecting 1,254 miles of land along |
---|
8 | 8 | | Texas' border with Mexico, a job that has become increasingly |
---|
9 | 9 | | violent as this state has succumbed to a foreign drug |
---|
10 | 10 | | cartel-facilitated invasion; and |
---|
11 | 11 | | WHEREAS, These foreign drug cartels bring terror to Texas |
---|
12 | 12 | | communities by flooding the streets with deadly narcotics, forcing |
---|
13 | 13 | | women and children into human and sex trafficking, enriching |
---|
14 | 14 | | themselves on the misery and enslavement of Texans, and butchering |
---|
15 | 15 | | and murdering anyone who tries to stop them; and |
---|
16 | 16 | | WHEREAS, In fiscal year 2021, U.S. Customs and Border |
---|
17 | 17 | | Protection reports over 200,000 pounds of illegal narcotics have |
---|
18 | 18 | | been seized from foreign drug cartels in Texas; and |
---|
19 | 19 | | WHEREAS, Specifically, federal seizures of fentanyl in Texas |
---|
20 | 20 | | have dramatically increased by more than 950 percent this fiscal |
---|
21 | 21 | | year; and |
---|
22 | 22 | | WHEREAS, In fiscal year 2021, the U.S. Border Patrol has |
---|
23 | 23 | | already arrested more than 7,800 noncitizens that were determined |
---|
24 | 24 | | to have prior criminal records; and |
---|
25 | 25 | | WHEREAS, The Office of the Texas Attorney General estimates |
---|
26 | 26 | | that there are 234,000 victims of labor trafficking and 79,000 |
---|
27 | 27 | | victims of youth and minor sex trafficking at any given time in |
---|
28 | 28 | | Texas; and |
---|
29 | 29 | | WHEREAS, State and local law enforcement agencies are forced |
---|
30 | 30 | | to contend with extensive and dangerous criminal activity resulting |
---|
31 | 31 | | from, or associated with, foreign drug cartels, thereby putting |
---|
32 | 32 | | Texas law enforcement officials in danger and draining resources |
---|
33 | 33 | | away from protecting our communities; and |
---|
34 | 34 | | WHEREAS, The State of Texas has attempted to address the |
---|
35 | 35 | | problem by adding hundreds of commissioned law enforcement officers |
---|
36 | 36 | | to the border, purchasing state-of-the-art helicopters, conducting |
---|
37 | 37 | | border security surge operations, and paying millions of dollars |
---|
38 | 38 | | for overtime, training, equipment, and technology for local law |
---|
39 | 39 | | enforcement; and |
---|
40 | 40 | | WHEREAS, Law enforcement agencies working together in Texas |
---|
41 | 41 | | have seized billions of dollars in illegal drugs and hundreds of |
---|
42 | 42 | | millions in cash, along with thousands of firearms and weapons, all |
---|
43 | 43 | | related to the foreign drug cartel-facilitated invasion; and |
---|
44 | 44 | | WHEREAS, Texas has repeatedly asked the federal government to |
---|
45 | 45 | | send more border security resources to the state, requesting an |
---|
46 | 46 | | increase in manpower of border patrol agents and the deployment of |
---|
47 | 47 | | National Guard troops; and |
---|
48 | 48 | | WHEREAS, Texas prisons house thousands of violent offenders |
---|
49 | 49 | | that claim foreign citizenship, and the state bears the cost of |
---|
50 | 50 | | housing and prosecuting those offenders; and |
---|
51 | 51 | | WHEREAS, Texas taxpayers have spent billions compensating |
---|
52 | 52 | | for the lack of federal resources provided to the state; and |
---|
53 | 53 | | WHEREAS, The unwillingness of the federal government to |
---|
54 | 54 | | develop a comprehensive plan that would address this border |
---|
55 | 55 | | security problem puts an unfair and unreasonable burden on the |
---|
56 | 56 | | entire state, but in particular on Texas border communities; and |
---|
57 | 57 | | WHEREAS, The federal government has failed to protect the |
---|
58 | 58 | | State of Texas from this foreign drug cartel-facilitated invasion |
---|
59 | 59 | | as required by Article IV, Section 4 of the United States |
---|
60 | 60 | | Constitution; and |
---|
61 | 61 | | WHEREAS, Under Article I, Section 10 of the United States |
---|
62 | 62 | | Constitution, Texas is entitled as a sovereign state of the United |
---|
63 | 63 | | States of America to protect itself against this current foreign |
---|
64 | 64 | | drug cartel-facilitated invasion, which grants the State of Texas |
---|
65 | 65 | | the power to defend the state when the state has been invaded, or is |
---|
66 | 66 | | "in such imminent Danger as will not admit of delay"; now, |
---|
67 | 67 | | therefore, be it |
---|
68 | 68 | | RESOLVED, That the 87th Legislature of the State of Texas, |
---|
69 | 69 | | 2nd Called Session, hereby respectfully request the federal |
---|
70 | 70 | | government to immediately declare violent foreign drug cartels as |
---|
71 | 71 | | foreign terrorist organizations under Section 219 of the |
---|
72 | 72 | | Immigration and Nationality Act, 8 U.S.C. ยง 1189; and, be it further |
---|
73 | 73 | | RESOLVED, That the Texas Legislature hereby find that foreign |
---|
74 | 74 | | drug cartels have facilitated an invasion of the State of Texas and |
---|
75 | 75 | | that the citizens of this state are in danger of irreparable harm; |
---|
76 | 76 | | and, be it further |
---|
77 | 77 | | RESOLVED, That the Texas Legislature hereby encourage the |
---|
78 | 78 | | Texas Military Department and all applicable state resources as |
---|
79 | 79 | | needed to use any and all authority under Article I, Section 10 of |
---|
80 | 80 | | the United States Constitution to repel this violent foreign drug |
---|
81 | 81 | | cartel-facilitated invasion, and that such authority should be |
---|
82 | 82 | | invoked as the authorization for use of military force with the |
---|
83 | 83 | | intention of utilizing such authority in the least lethal manner |
---|
84 | 84 | | possible consistent with bringing this facilitated invasion to a |
---|
85 | 85 | | conclusion at the earliest possible moment. |
