9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 48.005(d), Education Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | (d) The commissioner may adjust the average daily | |
13 | 13 | attendance of a school district in which a disaster, flood, extreme | |
14 | 14 | weather condition, fuel curtailment, or other calamity has a | |
15 | 15 | significant effect on the district's attendance. [In addition to | |
16 | 16 | providing the adjustment for the amount of instructional days | |
17 | 17 | during the semester in which the calamity first occurred, an | |
18 | 18 | adjustment under this section may only be provided based on a | |
19 | 19 | particular calamity for an additional amount of instructional days | |
20 | 20 | equivalent to one school year. The commissioner may divide the | |
21 | 21 | adjustment between two consecutive school years.] | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect on the 91st day after the last day of the | |
27 | 27 | legislative session. |
