77 relating to the adjustment of the average daily attendance of a
88 school district on the basis of a calamity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.005(d), Education Code, is amended to
1111 read as follows:
1212 (d) The commissioner may adjust the average daily
1313 attendance of a school district in which a disaster, flood, extreme
1414 weather condition, fuel curtailment, or other calamity has a
1515 significant effect on the district's attendance. [In addition to
1616 providing the adjustment for the amount of instructional days
1717 during the semester in which the calamity first occurred, an
1818 adjustment under this section may only be provided based on a
1919 particular calamity for an additional amount of instructional days
2020 equivalent to one school year. The commissioner may divide the
2121 adjustment between two consecutive school years.]
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect on the 91st day after the last day of the
2727 legislative session.
