55 AN ACT
66 relating to the use of demand response technology to reduce energy
77 consumption in state-owned buildings.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter I, Chapter 2166, Government Code, is
1010 amended by adding Section 2166.4021 to read as follows:
1111 Sec. 2166.4021. DEMAND RESPONSE TECHNOLOGY FOR STATE
1212 BUILDINGS. (a) The commission by rule shall adopt guidelines for
1313 the required use of demand response technology in state-owned
1414 buildings, including buildings otherwise exempt from this chapter
1515 under Section 2166.003, to reduce energy consumption for the
1616 buildings in response to energy supply constraints.
1717 (b) The guidelines adopted under Subsection (a) must
1818 require the remote reduction of building energy consumption by at
1919 least 30 percent during:
2020 (1) weather or energy emergencies; and
2121 (2) peak demand days as determined by the independent
2222 organization certified under Section 39.151, Utilities Code.
2323 SECTION 2. The Texas Facilities Commission shall adopt the
2424 guidelines required by Section 2166.4021, Government Code, as added
2525 by this Act, not later than February 1, 2022.
2626 SECTION 3. This Act takes effect on the 91st day after the
2727 last day of the legislative session.
