44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the salaries of sheriffs and to state assistance
77 payments to offset the cost of sheriff's salaries in certain
88 counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 152, Local Government
1111 Code, is amended by adding Section 152.0715 to read as follows:
1212 Sec. 152.0715. STATE FINANCIAL ASSISTANCE TO PAY SALARIES
1313 OF SHERIFFS OF CERTAIN COUNTIES. (a) This section applies only to
1414 a county with a population of less than 50,001.
1515 (b) To serve the state purpose of ensuring professional law
1616 enforcement throughout the state, a county is entitled to a state
1717 assistance payment from the state for each county fiscal year to
1818 assist the county in paying the sheriff's salary as follows:
1919 (1) if a county has a population of 25,000 or less, the
2020 county is entitled to a payment of $20,000; and
2121 (2) if a county has a population of more than 25,000
2222 and less than 50,001, the county is entitled to a payment of $5,000.
2323 (c) Not later than the 30th day after the first day of a
2424 county's fiscal year, the county must submit an application to the
2525 comptroller to receive the payment.
2626 (d) The comptroller shall remit the applicable state
2727 assistance payment to which a county is entitled from available
2828 state funds not later than the 30th day after the date the
2929 comptroller receives the county's application for the payment.
3030 (e) The comptroller shall adopt rules necessary to
3131 implement this section.
3232 SECTION 2. The changes in law made by this Act apply only to
3333 a county fiscal year that begins on or after September 1, 2023.
3434 SECTION 3. Not later than January 1, 2023, the comptroller
3535 of public accounts shall adopt rules as required by Section
3636 152.0715(e), Local Government Code, as added by this Act.
3737 SECTION 4. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect on the 91st day after the last day of the
4242 legislative session.
