66 AN ACT
77 relating to a policy requiring the use of face coverings in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.0022 to read as follows:
1212 Sec. 38.0022. FACE COVERING POLICY. Notwithstanding any
1313 other law, the board of trustees of a school district or the
1414 governing body of an open-enrollment charter school may require an
1515 individual to wear a face mask, face shield, or other face covering
1616 to reduce the spread of infectious, contagious, and communicable
1717 diseases when the individual is in the following settings operated
1818 by the district or school:
1919 (1) a school building;
2020 (2) a school bus; or
2121 (3) any other congregate educational setting in which
2222 children younger than 12 years of age may be present during times
2323 dedicated for educational purposes.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect on the 91st day after the last day of the
2929 legislative session.
