9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 38, Education Code, is | |
11 | 11 | amended by adding Section 38.0022 to read as follows: | |
12 | 12 | Sec. 38.0022. FACE COVERING POLICY. Notwithstanding any | |
13 | 13 | other law, the board of trustees of a school district or the | |
14 | 14 | governing body of an open-enrollment charter school may require an | |
15 | 15 | individual to wear a face mask, face shield, or other face covering | |
16 | 16 | to reduce the spread of infectious, contagious, and communicable | |
17 | 17 | diseases when the individual is in the following settings operated | |
18 | 18 | by the district or school: | |
19 | 19 | (1) a school building; | |
20 | 20 | (2) a school bus; or | |
21 | 21 | (3) any other congregate educational setting in which | |
22 | 22 | children younger than 12 years of age may be present during times | |
23 | 23 | dedicated for educational purposes. | |
24 | 24 | SECTION 2. This Act takes effect immediately if it receives | |
25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
28 | 28 | Act takes effect on the 91st day after the last day of the | |
29 | 29 | legislative session. |
