44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a prohibition on certain companies that receive
77 government contracts from requiring employees to receive a
88 vaccination.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 10, Government Code, is
1111 amended by adding Chapter 2275 to read as follows:
1212 CHAPTER 2275. MANDATORY VACCINATIONS PROHIBITED
1313 Sec. 2275.001. DEFINITIONS. In this chapter:
1414 (1) "Company" has the meaning assigned by Section
1515 808.001.
1616 (2) "Political subdivision" means a county,
1717 municipality, school district, special purpose district, or other
1818 subdivision of state government that has jurisdiction limited to a
1919 geographic portion of the state.
2020 (3) "State agency" has the meaning assigned by Section
2121 609.001.
2222 Sec. 2275.002. PROVISION REQUIRED IN CONTRACT. A state
2323 agency or political subdivision may not enter into a contract with a
2424 company for goods or services unless the contract contains a
2525 written verification from the company that it does not, and will
2626 not during the term of the contract, require, as a condition of
2727 employment, an employee to receive any vaccination.
2828 SECTION 2. Chapter 2275, Government Code, as added by this
2929 Act, applies only to a contract entered into on or after the
3030 effective date of this Act. A contract entered into before that date
3131 is governed by the law in effect on the date the contract was
3232 entered into, and the former law is continued in effect for that
3333 purpose.
3434 SECTION 3. This Act takes effect on the 91st day after the
3535 last day of the legislative session.
