88 Economic Stimulus Through Aid and Relief (LONESTAR) Supplemental
99 Appropriations Act of 2021; making appropriations and giving
1010 direction regarding appropriations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. SHORT TITLE. This Act may be cited as the Texas
1313 Leading on Opportunity, Investment, and Economic Stimulus Through
1414 Aid and Relief (LONESTAR) Supplemental Appropriations Act of 2021.
1515 SECTION 2. COMPTROLLER OF PUBLIC ACCOUNTS: RESTORATION OF
1616 STATE AGENCY BUDGET REDUCTIONS. (a) The amount of $1,000,000,000 is
1717 appropriated to the comptroller of public accounts from money
1818 received by this state from the Coronavirus State Fiscal Recovery
1919 Fund (42 U.S.C. Section 802) established under the American Rescue
2020 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
2121 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
2222 beginning September 1, 2021, for the purpose of restoring funding
2323 to state agencies, as authorized by other law, to make up for
2424 reductions in appropriated amounts equal to five percent of total
2525 appropriations made to state agencies from the general revenue fund
2626 and dedicated accounts in the general revenue fund for the state
2727 fiscal year ending August 31, 2021, made by Chapter 1353 (H.B. 1),
2828 Acts of the 86th Legislature, Regular Session, 2019 (the General
2929 Appropriations Act), due to the COVID-19 pandemic.
3030 (b) The comptroller, in consultation with the Legislative
3131 Budget Board, shall identify the strategies and objectives out of
3232 which the reductions in amounts appropriated to each state agency
3333 from the general revenue fund and dedicated accounts in the general
3434 revenue fund were made and allocate the money appropriated under
3535 Subsection (a) in a manner that, to the greatest extent
3636 practicable, restores the amounts appropriated to state agencies
3737 before the reductions in appropriations occurred.
3838 SECTION 3. COMPTROLLER OF PUBLIC ACCOUNTS: PREMIUM PAY FOR
3939 ELIGIBLE WORKERS EMPLOYED BY STATE AGENCIES. (a) In this section,
4040 "premium pay" and "eligible workers" have the meanings assigned by
4141 42 U.S.C. Section 802(g).
4242 (b) The amount of $1,000,000,000 is appropriated to the
4343 comptroller of public accounts from money received by this state
4444 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
4545 802) established under the American Rescue Plan Act of 2021
4646 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
4747 Relief Fund No. 325 for the state fiscal biennium beginning
4848 September 1, 2021, for the purpose of providing funding for premium
4949 pay for eligible workers employed by state agencies as authorized
5050 by other law.
5151 SECTION 4. TEXAS COMMISSION ON THE ARTS: ARTS AND CULTURAL
5252 GRANTS FOR PHYSICAL AND ECONOMIC DAMAGE. The amount of $11,000,000
5353 is appropriated to the Texas Commission on the Arts from money
5454 received by this state from the Coronavirus State Fiscal Recovery
5555 Fund (42 U.S.C. Section 802) established under the American Rescue
5656 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
5757 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
5858 beginning September 1, 2021, for the purpose of increasing funding
5959 for arts and cultural grants authorized by other law to offset
6060 physical damage caused by hurricanes or winter storms or economic
6161 damage caused by the COVID-19 pandemic.
6262 SECTION 5. TEXAS COMMISSION ON THE ARTS: ARTS AND CULTURAL
6363 GRANTS FOR SUMMER EDUCATION. The amount of $10,000,000 is
6464 appropriated to the Texas Commission on the Arts from money
6565 received by this state from the Coronavirus State Fiscal Recovery
6666 Fund (42 U.S.C. Section 802) established under the American Rescue
6767 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
6868 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
6969 beginning September 1, 2021, for the purpose of providing funding
7070 for arts and cultural grants authorized by other law benefiting
7171 nonprofit organizations that provide summer camps or summer
7272 education programming for students in this state.
7373 SECTION 6. TEXAS MUSIC OFFICE, TRUSTEED PROGRAMS WITHIN THE
7474 OFFICE OF THE GOVERNOR: MUSIC VENUE AND FESTIVAL REBATES. The
7575 amount of $10,000,000 is appropriated to the Texas Music Office
7676 within the Trusteed Programs within the Office of the Governor from
7777 money received by this state from the Coronavirus State Fiscal
7878 Recovery Fund (42 U.S.C. Section 802) established under the
7979 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
8080 to the credit of the Coronavirus Relief Fund No. 325 for the state
8181 fiscal biennium beginning September 1, 2021, for the purpose of
8282 providing funding for rebates for eligible music venues and
8383 festival promoters to reduce the impact of venue closures and
8484 social distancing requirements during the COVID-19 pandemic.
8585 SECTION 7. OFFICE OF THE GOVERNOR: SMALL BUSINESS DISASTER
8686 RECOVERY LOANS. The amount of $300,000,000 is appropriated to the
8787 Office of the Governor from money received by this state from the
8888 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
8989 established under the American Rescue Plan Act of 2021
9090 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
9191 Relief Fund No. 325 for the state fiscal biennium beginning
9292 September 1, 2021, for the purpose of providing funding for small
9393 business disaster recovery loans authorized by other law for small
9494 businesses that experienced physical damage caused by hurricanes or
9595 winter storms or economic damage caused by the COVID-19 pandemic.
9696 SECTION 8. COMPTROLLER OF PUBLIC ACCOUNTS: BROADBAND
9797 SERVICES. The amount of $3,000,000,000 is appropriated to the
9898 comptroller of public accounts from money received by this state
9999 from the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section
100100 802) established under the American Rescue Plan Act of 2021
101101 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
102102 Relief Fund No. 325 for the state fiscal biennium beginning
103103 September 1, 2021, for the purpose of providing funding for grants,
104104 loans, and incentives authorized by other law for broadband
105105 services in areas of the state currently in need of those services.
106106 SECTION 9. HISTORICAL COMMISSION: MAIN STREET PROGRAM. The
107107 amount of $2,000,000 is appropriated to the Historical Commission
108108 from money received by this state from the Coronavirus State Fiscal
109109 Recovery Fund (42 U.S.C. Section 802) established under the
110110 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
111111 to the credit of the Coronavirus Relief Fund No. 325 for the state
112112 fiscal biennium beginning September 1, 2021, for the purpose of
113113 providing funding for downtown and main street revitalization
114114 projects in small and rural municipalities designated as part of
115115 the Main Street Program, including projects for infrastructure
116116 improvement, to encourage tourism and economic development in rural
117117 areas impacted by the COVID-19 pandemic.
118118 SECTION 10. DEPARTMENT OF INFORMATION RESOURCES: IT LEGACY
119119 SYSTEMS AND CYBERSECURITY. The amount of $500,000,000 is
120120 appropriated to the Department of Information Resources from money
121121 received by this state from the Coronavirus State Fiscal Recovery
122122 Fund (42 U.S.C. Section 802) established under the American Rescue
123123 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
124124 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
125125 beginning September 1, 2021, for the purpose of upgrading and
126126 modernizing state agency information technology (IT) legacy
127127 systems and cybersecurity enhancements for state agency IT systems.
128128 SECTION 11. VETERANS COMMISSION: VETERANS ASSISTANCE. The
129129 amount of $100,000,000 is appropriated to the Veterans Commission
130130 from money received by this state from the Coronavirus State Fiscal
131131 Recovery Fund (42 U.S.C. Section 802) established under the
132132 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
133133 to the credit of the Coronavirus Relief Fund No. 325 for the state
134134 fiscal biennium beginning September 1, 2021, for the purpose of
135135 providing funding for general assistance grants, housing
136136 assistance grants, treatment court grants, and behavioral health
137137 assistance grants, as authorized by other law, to assist veterans
138138 who have been substantially impacted by the COVID-19 pandemic.
139139 SECTION 12. DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES:
140140 TEXAS HOME VISITING NURSE PROGRAM AND NURSE-FAMILY PARTNERSHIP
141141 PROGRAM. (a) The amount of $146,800,000 is appropriated to the
142142 Department of Family and Protective Services from money received by
143143 this state from the Coronavirus State Fiscal Recovery Fund (42
144144 U.S.C. Section 802) established under the American Rescue Plan Act
145145 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
146146 Coronavirus Relief Fund No. 325 for the state fiscal biennium
147147 beginning September 1, 2021, to be allocated as follows:
148148 (1) $71,200,000 to provide funding for the Texas Home
149149 Visiting Program; and
150150 (2) $75,600,000 to provide funding for the
151151 Nurse-Family Partnership Program to expand home visiting.
152152 (b) To the extent authorized by other law, the Department of
153153 Family and Protective Services shall coordinate with the Maternal
154154 Mortality Review Commission and the Office for the Elimination of
155155 Health Disparities to target the spending of money appropriated by
156156 Subsection (a) of this section to areas of the state with high
157157 instances of maternal mortality and severe maternal morbidity and
158158 high rates of removal of children from their homes.
159159 SECTION 13. DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES:
160160 FOSTER CARE PROVIDER CAPACITY. The amount of $65,800,000 is
161161 appropriated to the Department of Family and Protective Services
162162 from money received by this state from the Coronavirus State Fiscal
163163 Recovery Fund (42 U.S.C. Section 802) established under the
164164 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
165165 to the credit of the Coronavirus Relief Fund No. 325 for the state
166166 fiscal biennium beginning September 1, 2021, for the purpose of
167167 increasing foster care provider capacity, including through
168168 temporary rate increases, as authorized by other law.
169169 SECTION 14. DEPARTMENT OF STATE HEALTH SERVICES: HIV
170170 MEDICATION PROGRAM. The amount of $67,000,000 is appropriated to
171171 the Department of State Health Services from money received by this
172172 state from the Coronavirus State Fiscal Recovery Fund (42
173173 U.S.C. Section 802) established under the American Rescue Plan Act
174174 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
175175 Coronavirus Relief Fund No. 325 for the state fiscal biennium
176176 beginning September 1, 2021, for the purpose of providing
177177 additional funding for the HIV Medication Program.
178178 SECTION 15. DEPARTMENT OF STATE HEALTH SERVICES: FIREARM
179179 INJURY PREVENTION RESEARCH. The amount of $10,000,000 is
180180 appropriated to the Department of State Health Services from money
181181 received by this state from the Coronavirus State Fiscal Recovery
182182 Fund (42 U.S.C. Section 802) established under the American Rescue
183183 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
184184 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
185185 beginning September 1, 2021, for the purpose of providing funding
186186 for grants authorized by other law to health-related institutions
187187 in this state to conduct research into firearm injury prevention.
188188 To the extent authorized by other law, the department shall
189189 prioritize those research projects that have received federal
190190 funding to support the project.
191191 SECTION 16. DEPARTMENT OF STATE HEALTH SERVICES: OFFICE FOR
192192 THE ELIMINATION OF HEALTH DISPARITIES. The amount of $100,000,000
193193 is appropriated to the Department of State Health Services from
194194 money received by this state from the Coronavirus State Fiscal
195195 Recovery Fund (42 U.S.C. Section 802) established under the
196196 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
197197 to the credit of the Coronavirus Relief Fund No. 325 for the state
198198 fiscal biennium beginning September 1, 2021, for the purpose of
199199 providing funding for the department's Office for the Elimination
200200 of Health Disparities to support the office's evidence-based
201201 initiatives to reduce health conditions contributing to COVID-19
202202 mortality, including diabetes, cancer, heart disease, obesity, and
203203 smoking.
204204 SECTION 17. DEPARTMENT OF STATE HEALTH SERVICES: SURGE
205205 RESPONSE. The amount of $100,000,000 is appropriated to the
206206 Department of State Health Services from money received by this
207207 state from the Coronavirus State Fiscal Recovery Fund (42 U.S.C.
208208 Section 802) established under the American Rescue Plan Act of 2021
209209 (Pub. L. No. 117-2) and deposited to the credit of the Coronavirus
210210 Relief Fund No. 325 for the state fiscal biennium beginning
211211 September 1, 2021, for the purpose of providing, in coordination
212212 with the Texas Division of Emergency Management, grants and
213213 financial assistance authorized by other law to local and county
214214 health departments and hospital districts to respond to surges in
215215 COVID-19 cases and to maintain access to health care services
216216 during surges in COVID-19 cases.
217217 SECTION 18. HEALTH AND HUMAN SERVICES COMMISSION:
218218 POSTPARTUM MEDICAID BENEFITS. The amount of $91,400,000 is
219219 appropriated to the Health and Human Services Commission from money
220220 received by this state from the Coronavirus State Fiscal Recovery
221221 Fund (42 U.S.C. Section 802) established under the American Rescue
222222 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
223223 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
224224 beginning September 1, 2021, for the purpose of extending maternal
225225 postpartum Medicaid benefits for an additional six months as
226226 authorized by other law.
227227 SECTION 19. HEALTH AND HUMAN SERVICES COMMISSION: MENTAL
228228 AND BEHAVIORAL HEALTH AND SUBSTANCE USE DISORDER TREATMENT. (a)
229229 The amount of $928,000,000 is appropriated to the Health and Human
230230 Services Commission from money received by this state from the
231231 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
232232 established under the American Rescue Plan Act of 2021 (Pub. L.
233233 No. 117-2) and deposited to the credit of the Coronavirus Relief
234234 Fund No. 325 for the state fiscal biennium beginning September 1,
235235 2021, for the purpose of providing funding for mental and
236236 behavioral health and substance use disorder treatment.
237237 (b) Out of money appropriated by Subsection (a) of this
238238 section, the amount of:
239239 (1) $50,000,000 may be used only to provide funding
240240 for evidence-based initiatives for survivors of domestic assault
241241 and sexual assault authorized by other law;
242242 (2) $47,200,000 may be used only to reduce the
243243 substance use treatment waitlist for pregnant women and women with
244244 children in the manner authorized by other law;
245245 (3) $10,000,000 may be used only to provide funding
246246 for a temporary rate increase for substance use treatment services
247247 in the manner authorized by other law;
248248 (4) $10,000,000 may be used only to provide funding
249249 for evidence-based initiatives to reduce opioid addiction in this
250250 state authorized by other law; and
251251 (5) $40,000,000 may be used only to support mobile
252252 crisis services authorized by other law that are available 24 hours
253253 a day, 7 days a week.
254254 SECTION 20. HEALTH AND HUMAN SERVICES COMMISSION: MENTAL
255255 HEALTH INITIATIVES. The amount of $10,000,000 is appropriated to
256256 the Health and Human Services Commission from money received by
257257 this state from the Coronavirus State Fiscal Recovery Fund (42
258258 U.S.C. Section 802) established under the American Rescue Plan Act
259259 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
260260 Coronavirus Relief Fund No. 325 for the state fiscal biennium
261261 beginning September 1, 2021, for the purpose of supporting
262262 evidence-based initiatives authorized by other law that address
263263 trauma relating to the COVID-19 pandemic and promote children's
264264 mental health, including providing proportional rate increases for
265265 providers, hospitals, rural hospitals, and graduate medical
266266 institutions with COVID-19 patients and expanding access to mental
267267 health care and telemedicine.
268268 SECTION 21. HEALTH AND HUMAN SERVICES COMMISSION: EARLY
269269 CHILDHOOD INTERVENTION SERVICE PROVIDERS. The amount of
270270 $81,000,000 is appropriated to the Health and Human Services
271271 Commission from money received by this state from the Coronavirus
272272 State Fiscal Recovery Fund (42 U.S.C. Section 802) established
273273 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
274274 deposited to the credit of the Coronavirus Relief Fund No. 325 for
275275 the state fiscal biennium beginning September 1, 2021, for the
276276 purpose of increasing rates for early childhood intervention
277277 service providers as authorized by other law.
278278 SECTION 22. HEALTH AND HUMAN SERVICES COMMISSION: PROVIDERS
279279 AND HOSPITALS. (a) The amount of $1,000,000,000 is appropriated to
280280 the Health and Human Services Commission from money received by
281281 this state from the Coronavirus State Fiscal Recovery Fund (42
282282 U.S.C. Section 802) established under the American Rescue Plan Act
283283 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
284284 Coronavirus Relief Fund No. 325 for the state fiscal biennium
285285 beginning September 1, 2021, for the purpose of providing rate
286286 increases and incentive payments, as authorized by other law, to
287287 providers and hospitals that have been substantially affected by
288288 the COVID-19 pandemic to retain and attract staff necessary to
289289 handle surges in COVID-19 case counts and to maintain access to
290290 emergency surgeries and to vital, elective, and non-cosmetic
291291 surgeries.
292292 (b) To the extent authorized by other law, the commission
293293 shall collaborate with affected industries to develop a payment
294294 methodology for incentive payments made from money appropriated by
295295 Subsection (a) of this section. The methodology must:
296296 (1) provide for quarterly lump sum payments;
297297 (2) accurately reflect COVID-19-related costs; and
298298 (3) prioritize providers and hospitals that have not
299299 received other federal or state COVID-19 relief funding.
300300 (c) To receive incentive payments, a provider or hospital
301301 must submit to the commission quarterly a report of the provider's
302302 or hospital's COVID-19-related costs. As authorized by other law, a
303303 provider or hospital that receives an incentive payment from money
304304 appropriated by Subsection (a) of this section is subject to audit
305305 by the State Auditor's Office and the Office of the Inspector
306306 General and the provider or hospital may be required to return a
307307 payment if an audit demonstrates that fraud, waste, or abuse
308308 occurred.
309309 SECTION 23. HEALTH AND HUMAN SERVICES COMMISSION, OFFICE OF
310310 THE INSPECTOR GENERAL: FRAUD INVESTIGATIONS. The amount of
311311 $5,000,000 is appropriated to the Health and Human Services
312312 Commission, Office of the Inspector General, from money received by
313313 this state from the Coronavirus State Fiscal Recovery Fund (42
314314 U.S.C. Section 802) established under the American Rescue Plan Act
315315 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
316316 Coronavirus Relief Fund No. 325 for the state fiscal biennium
317317 beginning September 1, 2021, for the purpose of increasing
318318 activities authorized by other law to detect, recoup, and prevent
319319 instances of fraud, waste, and abuse relating to COVID-19
320320 flexibilities in state public benefit programs.
321321 SECTION 24. TEXAS EDUCATION AGENCY: GRANTS TO SCHOOL
322322 DISTRICTS FOR PERSONAL PROTECTIVE EQUIPMENT AND TESTING. The
323323 amount of $100,000,000 is appropriated to the Texas Education
324324 Agency from money received by this state from the Coronavirus State
325325 Fiscal Recovery Fund (42 U.S.C. Section 802) established under the
326326 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
327327 to the credit of the Coronavirus Relief Fund No. 325 for the state
328328 fiscal biennium beginning September 1, 2021, for the purpose of
329329 providing grants as authorized by other law to school districts to
330330 support personal protective equipment acquisition and targeted
331331 COVID-19 testing for teachers and students.
332332 SECTION 25. TEXAS EDUCATION AGENCY: GRANTS TO SCHOOL
333333 DISTRICTS FOR ONLINE LEARNING AND ADDRESSING LEARNING
334334 DEFICIENCIES. The amount of $81,000,000 is appropriated to the
335335 Texas Education Agency from money received by this state from the
336336 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
337337 established under the American Rescue Plan Act of 2021 (Pub. L.
338338 No. 117-2) and deposited to the credit of the Coronavirus Relief
339339 Fund No. 325 for the state fiscal biennium beginning September 1,
340340 2021, for the purpose of providing grants as authorized by other law
341341 to school districts to bolster online learning capabilities and
342342 address student learning deficiencies resulting from the COVID-19
343343 pandemic.
344344 SECTION 26. HIGHER EDUCATION COORDINATING BOARD: STUDENT
345345 FINANCIAL EMERGENCIES. (a) The amount of $60,000,000 is
346346 appropriated to the Texas Higher Education Coordinating Board from
347347 money received by this state from the Coronavirus State Fiscal
348348 Recovery Fund (42 U.S.C. Section 802) established under the
349349 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
350350 to the credit of the Coronavirus Relief Fund No. 325 for the state
351351 fiscal biennium beginning September 1, 2021, for the purpose of
352352 providing grants as authorized by other law to assist undergraduate
353353 and graduate students to overcome financial emergencies that
354354 threaten their ability to complete their courses of study.
355355 (b) A student who receives a grant under Subsection (a) of
356356 this section:
357357 (1) must have completed not less than 50 percent of the
358358 student's coursework;
359359 (2) must have a passing cumulative grade point
360360 average; and
361361 (3) may not be the cause of the financial emergency.
362362 SECTION 27. HIGHER EDUCATION COORDINATING BOARD: CAREERS IN
363363 SCIENCE, TECHNOLOGY, MATHEMATICS, AND ENGINEERING. (a) The amount
364364 of $100,000,000 is appropriated to the Texas Higher Education
365365 Coordinating Board from money received by this state from the
366366 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
367367 established under the American Rescue Plan Act of 2021 (Pub. L.
368368 No. 117-2) and deposited to the credit of the Coronavirus Relief
369369 Fund No. 325 for the state fiscal biennium beginning September 1,
370370 2021, to be distributed as authorized by other law in coordination
371371 with the Texas Education Agency and Texas Workforce Commission for
372372 programs at universities and junior colleges to train undergraduate
373373 and graduate students for careers that contribute to this state's
374374 future economic and workforce needs with a focus on careers in
375375 science, technology, mathematics, and engineering fields.
376376 (b) To the extent authorized by other law, the board shall
377377 ensure that at least $25,000,000 of the money appropriated by
378378 Subsection (a) of this section is distributed to programs at
379379 universities and junior colleges that retrain workers who lost jobs
380380 in industries severely affected by the COVID-19 pandemic.
381381 SECTION 28. TEXAS DIVISION OF EMERGENCY MANAGEMENT:
382382 STRATEGIC PERSONAL PROTECTIVE EQUIPMENT STOCKPILE. The amount of

384384 Management from money received by this state from the Coronavirus
385385 State Fiscal Recovery Fund (42 U.S.C. Section 802) established
386386 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
387387 deposited to the credit of the Coronavirus Relief Fund No. 325 for
388388 the state fiscal biennium beginning September 1, 2021, for the
389389 purpose of establishing and maintaining a strategic personal
390390 protective equipment and medical supply stockpile for the state
391391 based on planning required by legislation passed by the 87th
392392 Legislature as authorized by that legislation.
393393 SECTION 29. DEPARTMENT OF PUBLIC SAFETY: TESTING AND
394394 PERSONAL PROTECTIVE EQUIPMENT. The amount of $5,000,000 is
395395 appropriated to the Department of Public Safety from money received
396396 by this state from the Coronavirus State Fiscal Recovery Fund (42
397397 U.S.C. Section 802) established under the American Rescue Plan Act
398398 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
399399 Coronavirus Relief Fund No. 325 for the state fiscal biennium
400400 beginning September 1, 2021, for the purpose of providing targeted
401401 COVID-19 testing and purchasing personal protective equipment for
402402 law enforcement officers and other public safety employees as
403403 authorized by other law.
404404 SECTION 30. SUPREME COURT OF TEXAS: LEGAL REPRESENTATION
405405 GRANTS FOR EVICTEES. The amount of $10,000,000 is appropriated to
406406 the Supreme Court of Texas from money received by this state from
407407 the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
408408 established under the American Rescue Plan Act of 2021 (Pub. L.
409409 No. 117-2) and deposited to the credit of the Coronavirus Relief
410410 Fund No. 325 for the state fiscal biennium beginning September 1,
411411 2021, for the purpose of providing, in consultation with the Texas
412412 Access to Justice Commission and State Bar of Texas, grants
413413 authorized by other law to provide legal representation for
414414 individuals facing eviction due to economic effects and other legal
415415 issues caused by the COVID-19 pandemic.
416416 SECTION 31. SUPREME COURT OF TEXAS: REDUCTION OF COURT
417417 BACKLOG. (a) The amount of $20,000,000 is appropriated to the
418418 Supreme Court of Texas from money received by this state from the
419419 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
420420 established under the American Rescue Plan Act of 2021 (Pub. L.
421421 No. 117-2) and deposited to the credit of the Coronavirus Relief
422422 Fund No. 325 for the state fiscal biennium beginning September 1,
423423 2021, for the purpose of providing, in coordination with the Office
424424 of Court Administration of the Texas Judicial System, grants
425425 authorized by other law to courts, counties, and district
426426 attorneys' offices to reduce court backlogs caused by the COVID-19
427427 pandemic.
428428 (b) To the extent authorized by other law, the grants
429429 provided under Subsection (a) of this section must be distributed
430430 proportionally among courts, counties, and district attorneys'
431431 offices based on the size of the populations served by the
432432 applicable entity and the size of the backlog of the applicable
433433 entity.
434434 SECTION 32. SUPREME COURT OF TEXAS: REDUCTION OF CRIMINAL
435435 JUSTICE CASE BACKLOG. The amount of $15,000,000 is appropriated to
436436 the Supreme Court of Texas from money received by this state from
437437 the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
438438 established under the American Rescue Plan Act of 2021 (Pub. L.
439439 No. 117-2) and deposited to the credit of the Coronavirus Relief
440440 Fund No. 325 for the state fiscal biennium beginning September 1,
441441 2021, for the purpose of providing grants authorized by other law to
442442 support programs that reduce the criminal justice case backlog
443443 through mental health and drug courts and community supervision and
444444 diversion programs for low-level, nonviolent first-time offenders.
445445 SECTION 33. TEXAS DEPARTMENT OF AGRICULTURE: NUTRITIONAL
446446 PROGRAMS. The amount of $30,000,000 is appropriated to the Texas
447447 Department of Agriculture from money received by this state from
448448 the Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
449449 established under the American Rescue Plan Act of 2021 (Pub. L.
450450 No. 117-2) and deposited to the credit of the Coronavirus Relief
451451 Fund No. 325 for the state fiscal biennium beginning September 1,
452452 2021, for the purpose of supporting food and nutritional programs
453453 and allocated as follows:
454454 (1) $20,000,000 for the Texans Feeding Texans - Home
455455 Delivered Meals Grant Program; and
456456 (2) $10,000,000 for the Texans Feeding Texans -
457457 Surplus Agricultural Products Grant Program.
458458 SECTION 34. TEXAS DEPARTMENT OF AGRICULTURE: DOWNTOWN AND
459459 MAIN STREET REVITALIZATION PROJECTS. The amount of $2,000,000 is
460460 appropriated to the Texas Department of Agriculture from money
461461 received by this state from the Coronavirus State Fiscal Recovery
462462 Fund (42 U.S.C. Section 802) established under the American Rescue
463463 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
464464 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
465465 beginning September 1, 2021, for the purpose of supporting downtown
466466 and main street revitalization projects, including infrastructure
467467 improvement, in rural municipalities and towns, as authorized by
468468 other law, to encourage tourism and economic development in rural
469469 areas affected by the COVID-19 pandemic.
470470 SECTION 35. PARKS AND WILDLIFE DEPARTMENT: DEFERRED
471471 MAINTENANCE OF STATE PARKS. The amount of $700,000,000 is
472472 appropriated to the Parks and Wildlife Department from money
473473 received by this state from the Coronavirus State Fiscal Recovery
474474 Fund (42 U.S.C. Section 802) established under the American Rescue
475475 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
476476 the Coronavirus Relief Fund No. 325 for the state fiscal biennium
477477 beginning September 1, 2021, for the purpose of addressing unfunded
478478 deferred maintenance of state parks.
479479 SECTION 36. WATER DEVELOPMENT BOARD: CLEAN DRINKING WATER
480480 AND FLOODING AND WASTEWATER INFRASTRUCTURE. (a) The amount of
481481 $100,000,000 is appropriated to the Water Development Board from
482482 money received by this state from the Coronavirus State Fiscal
483483 Recovery Fund (42 U.S.C. Section 802) established under the
484484 American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and deposited
485485 to the credit of the Coronavirus Relief Fund No. 325 for the state
486486 fiscal biennium beginning September 1, 2021, for the purpose of
487487 providing loans and grants and issuing bonds authorized by other
488488 law to support clean drinking water and flooding and wastewater
489489 infrastructure.
490490 (b) To the extent authorized by other law, the board shall
491491 ensure that at least $25,000,000 of the money appropriated by
492492 Subsection (a) of this section is used to provide loans and grants
493493 and issue bonds for economically distressed areas of this state and
494494 high-risk areas with a substantial need for clean drinking water
495495 and flooding and wastewater infrastructure.
496496 SECTION 37. DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS:
497497 AFFORDABLE HOUSING. The amount of $500,000,000 is appropriated to
498498 the Department of Housing and Community Affairs from money received
499499 by this state from the Coronavirus State Fiscal Recovery Fund (42
500500 U.S.C. Section 802) established under the American Rescue Plan Act
501501 of 2021 (Pub. L. No. 117-2) and deposited to the credit of the
502502 Coronavirus Relief Fund No. 325 for the state fiscal biennium
503503 beginning September 1, 2021, for the purpose of addressing housing
504504 issues caused by the COVID-19 pandemic, as authorized by other law,
505505 including by providing access to and availability of safe,
506506 affordable housing through initiatives that may include new housing
507507 development, upgrades to infrastructure, and weatherization of
508508 existing affordable housing units.
509509 SECTION 38. TEXAS WORKFORCE COMMISSION: CHILD CARE. The
510510 amount of $5,000,000 is appropriated to the Texas Workforce
511511 Commission from money received by this state from the Coronavirus
512512 State Fiscal Recovery Fund (42 U.S.C. Section 802) established
513513 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2) and
514514 deposited to the credit of the Coronavirus Relief Fund No. 325 for
515515 the state fiscal biennium beginning September 1, 2021, for the
516516 purpose of providing child care to unemployed or recently employed
517517 caregivers of children to support reentry into the workforce for
518518 individuals who lost employment due to the COVID-19 pandemic.
519519 SECTION 39. COMPTROLLER OF PUBLIC ACCOUNTS: UNEMPLOYMENT
520520 COMPENSATION FUND. For the two-year period beginning on the
521521 effective date of this Act, the amount of $4,500,000,000 is
522522 appropriated to the comptroller of public accounts from money
523523 received by this state from the Coronavirus State Fiscal Recovery
524524 Fund (42 U.S.C. Section 802) established under the American Rescue
525525 Plan Act of 2021 (Pub. L. No. 117-2) and deposited to the credit of
526526 the Coronavirus Relief Fund No. 325, for deposit to the credit of
527527 the unemployment compensation fund under Section 203.021, Labor
528528 Code, for the purpose of paying back outstanding advances received
529529 by this state under Section 1201, Social Security Act (42 U.S.C.
530530 Section 1321), and returning the unemployment compensation fund to
531531 the statutory floor computed under Section 204.061, Labor Code, on
532532 October 1, 2021, as reimbursement for payments made as a result of
533533 the coronavirus disease pandemic.
534534 SECTION 40. APPROPRIATION: ELECTRICAL GRID IMPROVEMENTS.
535535 The amount of $1,000,000,000 is appropriated to the Public
536536 Utilities Commission from money received by this state from the
537537 Coronavirus State Fiscal Recovery Fund (42 U.S.C. Section 802)
538538 established under the American Rescue Plan Act of 2021 (Pub. L.
539539 No. 117-2) and deposited to the credit of the Coronavirus Relief
540540 Fund No. 325 for the state fiscal biennium beginning September 1,
541541 2021, for the purpose of providing, in coordination with the
542542 Railroad Commission of Texas, Electric Reliability Council of
543543 Texas, Texas Commission on Environmental Quality, Texas Division of
544544 Emergency Management, Texas Electric Supply Chain Security and
545545 Mapping Committee, and Texas Energy Reliability Council, funding
546546 for grants, loans, and incentives authorized by other law to
547547 support electrical grid and infrastructure weatherization,
548548 hardening, resiliency, and improvements, with a focus on projects
549549 that do not increase energy bills and taxes paid by homeowners and
550550 businesses.
551551 SECTION 41. REPORTING REQUIREMENTS. Each state agency to
552552 which money is appropriated under this Act shall submit to the
553553 governor, lieutenant governor, speaker of the house of
554554 representatives, members of the Senate Finance Committee, and
555555 members of the House Appropriations Committee each quarter any
556556 report the agency is required to submit to the United States
557557 secretary of the treasury in accordance with 42 U.S.C. Section
558558 802(d)(2).
559559 SECTION 42. USE OF MONEY FOR BORDER WALL PROHIBITED. Money
560560 appropriated by this Act may not be used to construct, renovate,
561561 maintain, or otherwise facilitate the construction or maintenance
562562 of a wall, fence, or other barrier on public or private land along
563563 the United States' international border with Mexico.
564564 SECTION 43. Section 17.16, Article IX, Chapter 1053 (S.B.
565565 1), Acts of the 87th Legislature, Regular Session, 2021 (the
566566 General Appropriations Act), is repealed.
567567 SECTION 44. This Act takes effect immediately.
