55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to weatherization of certain natural gas facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 81.073(b), Natural Resources Code, as
1010 added by Section 4, Chapter 426 (S.B. 3), Acts of the 87th
1111 Legislature, Regular Session, 2021, is amended to read as follows:
1212 (b) The rules must:
1313 (1) establish criteria for designating persons who own
1414 or operate a facility under the jurisdiction of the commission
1515 under Section 81.051(a) or engage in an activity under the
1616 jurisdiction of the commission under Section 81.051(a) who must
1717 provide critical customer and critical gas supply information, as
1818 defined by the commission, to the entities described by Section
1919 38.074(b)(1), Utilities Code; and
2020 (2) consider essential operational elements when
2121 defining critical customer designations and critical gas supply
2222 information for the purposes of Subdivision (1), including natural
2323 gas production, processing, and transportation, related produced
2424 water handling and disposal facilities, and the delivery of natural
2525 gas to generators of electric energy[; and
2626 [(3) require that only facilities and entities that
2727 are prepared to operate during a weather emergency may be
2828 designated as a critical customer under this section].
2929 SECTION 2. Section 86.044(b), Natural Resources Code, is
3030 amended to read as follows:
3131 (b) This section applies only to a gas supply chain facility
3232 that is:
3333 (1) included on the electricity supply chain map
3434 created under Section 38.203, Utilities Code,[;] and
3535 [(2)] designated as critical by the commission in the
3636 manner provided by Section 81.073; or
3737 (2) a facility used for producing natural gas.
3838 SECTION 3. Section 81.073, Natural Resources Code, as added
3939 by Section 1, Chapter 931 (H.B. 3648), Acts of the 87th Legislature,
4040 Regular Session, 2021, is repealed.
4141 SECTION 4. The change in law made by this Act to Section
4242 86.044(b), Natural Resources Code, applies only to a facility for
4343 which drilling is begun on or after the effective date of this Act.
4444 A facility for which drilling was begun before the effective date of
4545 this Act is governed by the law in effect at the time drilling was
4646 begun, and the former law is continued in effect for that purpose.
4747 SECTION 5. This Act takes effect on the 91st day after the
4848 last day of the legislative session.
