| 7 | 7 | | relating to weatherization of certain natural gas facilities. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 81.073(b), Natural Resources Code, as |
|---|
| 10 | 10 | | added by Section 4, Chapter 426 (S.B. 3), Acts of the 87th |
|---|
| 11 | 11 | | Legislature, Regular Session, 2021, is amended to read as follows: |
|---|
| 12 | 12 | | (b) The rules must: |
|---|
| 13 | 13 | | (1) establish criteria for designating persons who own |
|---|
| 14 | 14 | | or operate a facility under the jurisdiction of the commission |
|---|
| 15 | 15 | | under Section 81.051(a) or engage in an activity under the |
|---|
| 16 | 16 | | jurisdiction of the commission under Section 81.051(a) who must |
|---|
| 17 | 17 | | provide critical customer and critical gas supply information, as |
|---|
| 18 | 18 | | defined by the commission, to the entities described by Section |
|---|
| 19 | 19 | | 38.074(b)(1), Utilities Code; and |
|---|
| 20 | 20 | | (2) consider essential operational elements when |
|---|
| 21 | 21 | | defining critical customer designations and critical gas supply |
|---|
| 22 | 22 | | information for the purposes of Subdivision (1), including natural |
|---|
| 23 | 23 | | gas production, processing, and transportation, related produced |
|---|
| 24 | 24 | | water handling and disposal facilities, and the delivery of natural |
|---|
| 25 | 25 | | gas to generators of electric energy[; and |
|---|
| 26 | 26 | | [(3) require that only facilities and entities that |
|---|
| 27 | 27 | | are prepared to operate during a weather emergency may be |
|---|
| 28 | 28 | | designated as a critical customer under this section]. |
|---|
| 29 | 29 | | SECTION 2. Section 86.044(b), Natural Resources Code, is |
|---|
| 30 | 30 | | amended to read as follows: |
|---|
| 31 | 31 | | (b) This section applies only to a gas supply chain facility |
|---|
| 32 | 32 | | that is: |
|---|
| 33 | 33 | | (1) included on the electricity supply chain map |
|---|
| 34 | 34 | | created under Section 38.203, Utilities Code,[;] and |
|---|
| 35 | 35 | | [(2)] designated as critical by the commission in the |
|---|
| 36 | 36 | | manner provided by Section 81.073; or |
|---|
| 37 | 37 | | (2) a facility used for producing natural gas. |
|---|
| 38 | 38 | | SECTION 3. Section 81.073, Natural Resources Code, as added |
|---|
| 39 | 39 | | by Section 1, Chapter 931 (H.B. 3648), Acts of the 87th Legislature, |
|---|
| 40 | 40 | | Regular Session, 2021, is repealed. |
|---|
| 41 | 41 | | SECTION 4. The change in law made by this Act to Section |
|---|
| 42 | 42 | | 86.044(b), Natural Resources Code, applies only to a facility for |
|---|
| 43 | 43 | | which drilling is begun on or after the effective date of this Act. |
|---|
| 44 | 44 | | A facility for which drilling was begun before the effective date of |
|---|
| 45 | 45 | | this Act is governed by the law in effect at the time drilling was |
|---|
| 46 | 46 | | begun, and the former law is continued in effect for that purpose. |
|---|
| 47 | 47 | | SECTION 5. This Act takes effect on the 91st day after the |
|---|
| 48 | 48 | | last day of the legislative session. |
