55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing the issuance of revenue bonds for capital
88 projects at The University of Texas of the Permian Basin.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Section 55.1792 to read as follows:
1212 Sec. 55.1792. THE UNIVERSITY OF TEXAS OF THE PERMIAN BASIN;
1313 ADDITIONAL BONDS. (a) In addition to the other authority granted
1414 under this subchapter, the board of regents of The University of
1515 Texas System may acquire, purchase, construct, improve, renovate,
1616 enlarge, or equip property and facilities, including roads and
1717 related infrastructure, for The University of Texas of the Permian
1818 Basin for renovation of the Mesa Building and campus
1919 transformation, to be financed by the issuance of bonds in
2020 accordance with a systemwide revenue financing program and secured
2121 as provided by that program, in an aggregate principal amount not to
2222 exceed $70 million.
2323 (b) The board may pledge irrevocably to the payment of the
2424 bonds authorized by this section all or any part of the revenue
2525 funds of an institution, branch, or entity of The University of
2626 Texas System, including student tuition charges. The amount of a
2727 pledge made under this subsection may not be reduced or abrogated
2828 while the bonds for which the pledge is made, or bonds issued to
2929 refund those bonds, are outstanding.
3030 (c) If sufficient funds are not available to the board to
3131 meet its obligations under this section, the board may transfer
3232 funds among institutions, branches, and entities of The University
3333 of Texas System to ensure the most equitable and efficient
3434 allocation of available resources for each institution, branch, or
3535 entity to carry out its duties and purposes.
3636 SECTION 2. This Act does not affect any authority or
3737 restriction regarding the activities that a public institution of
3838 higher education may conduct in connection with a facility financed
3939 by bonds authorized by this Act.
4040 SECTION 3. This Act takes effect on the 91st day after the
4141 last day of the legislative session.
