55 AN ACT
66 relating to a prohibition on certain governmental contracts with
77 companies that require employees to receive a COVID-19 vaccination.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 10, Government Code, is
1010 amended by adding Chapter 2275 to read as follows:
1111 CHAPTER 2275. MANDATORY COVID-19 VACCINATIONS PROHIBITED
1212 Sec. 2275.001. DEFINITIONS. In this chapter:
1313 (1) "Company" has the meaning assigned by Section
1414 808.001.
1515 (2) "Political subdivision" means a county,
1616 municipality, school district, special purpose district, or other
1717 subdivision of state government that has jurisdiction limited to a
1818 geographic portion of the state.
1919 (3) "State agency" has the meaning assigned by Section
2020 609.001.
2121 Sec. 2275.002. PROVISION REQUIRED IN CONTRACT. A state
2222 agency or political subdivision may not enter into a contract with a
2323 company for goods or services unless the contract contains a
2424 written verification from the company that it does not, and will not
2525 during the term of the contract, require, as a condition of
2626 employment, an employee to receive any COVID-19 vaccination.
2727 SECTION 2. Chapter 2275, Government Code, as added by this
2828 Act, applies only to a contract entered into on or after the
2929 effective date of this Act. A contract entered into before that
3030 date is governed by the law in effect on the date the contract was
3131 entered into, and the former law is continued in effect for that
3232 purpose.
3333 SECTION 3. This Act takes effect on the 91st day after the
3434 last day of the legislative session.
